The aim of this research is to analyze the adoption and execution of the municipal police system by the current and the former administrations, and to ascertain the desirable direction of development. Korea has implemented municipality in 1991, and the implementation of a municipal police system was to follow. However, due to the circumstances such as the conflict between North Korea, the municipal police system has not yet been implemented to this date. In July 1, 2006, the Roh Moo-hyun administration implemented the municipal police system in Jeju Special Self-Governing Province, but failed to further expand the system beyond the island of Jeju. The Lee Myung-bak administration has also endeavored to implement the municipal police system at a local level since its start in February 2008, the progress was automatically nullified with the termination of the 18th national assembly. The Park Geun-hye administration came to power in February 2013 and established the Presidential Committee on Local Autonomy Development, put together a TFT to prepare for the implementation and execution of the municipal police system, and wrote the tentatively named Act on Municipal Police, it is yet unknown when the bill will be introduced to the National Assembly, as there still remains procedures such as supplementing the act through public hearings, etc. Furthermore, even if the bill is introduced, it is probable that the opposing parties will be pitted against each other, making it hard for an agreement to be reached. Above all, the complex political environment both domestically and internationally - such as the issue of nuclear experiments conducted by North Korea, the upcoming presidential election in the second half of next year, etc. - is keeping the issue of the municipal police system from rising to the surface. It is inevitable that the government, the national assembly, and the National Police Agency show their strong will for the municipal police system for it to be implemented during President Park’s administration. And measures such as public hearings attended by citizens, and televised debates need to be employed for the resolution of conflicting points, and it is also necessary to strive to establish the desired environment for the implementation prior to the actual execution. After the implementation of municipality in 1991, Korea has also enforced autonomy in the areas of education and firefighting, and the last step remaining is the implementation of the municipal police system. The implementation of the municipal police system is a step toward the age of complete municipality.

본 연구는 자치경찰제 도입에 대한 역대 정부와 현 정부의 추진실태를 분석하고 향후 발전방향을 모색하는데 목적을 두고 수행되었다. 우리나라는 1991년 지방자치제를 전격 실시하였고 이와 더불어 자치경찰제도 시행했어야 했지만, 남북한 간의 대치 상황 등으로 인해 실현되지 못한 채 오늘에 이르고 있다. 2006년 7월 1일 노무현 정부는 섬지역인 제주특별자치 도에서만 자치경찰제를 도입하였고 전국적으로 확대 도입하는 데는 실패하였다. 그 후 2008년 2월 출범했던 이명박 정부에서도 자치경찰제를 기초단위에서 도 입시행하려는 노력을 시도했으나 18대 국회의 임기만료와 함께 자동폐기 되었다. 이어서 2013년 2월에 출범한 박근혜 정부 지방자치발전위원회를 설치하고 본 위원회에서 자치경찰제 도입 및 추진을 준비하기 위한 TFT을 구성하고 (가칭)자 치경찰법(안)을 만들었지만, 아직 공청회 등을 통한 보완 의견수렴 절차 등이 남 아 있어 언제 국회에 상정될지 예측할 수 없는 실정이다. 또한 상정되더라도 여야 간의 첨예한 의견 대립이 예상되어 그 합의가 쉽지 않는 상황이다. 무엇보다 북한 의 핵실험과 국내 정치적 갈등 및 내년 하반기에 예정된 대통령 선거 등 국내외의 복잡한 정치 환경 등으로 인해 자치경찰제 도입이 아직까지는 수면 아래로 잠수한 상태에 머물러 있다. 결국 박근혜 정부에서 자치경찰제가 도입되기 위해서는 정부와 국회 및 경찰청 의 적극적인 추진의지가 필요하며 동시에 시민공청회와 TV 토론회 등을 통한 쟁 점해소는 물론이고 그 실행을 위한 환경조성을 확대해 나가야 한다. 우리나라는 1991년 지방자치제를 도입한 이후 교육자치와 소방자치를 시행하였고 마지막 남 은 자치경찰제를 도입해야 하는 과제를 남겨두고 있다. 향후 자치경찰제 도입은 지방자치 시대의 완성을 위해 한걸음 다가가는 것으로 인식된다.
