After the independence, special judicial police system was first introduced in 1956. From the time, the system was lively introduced to central governmental departments and local governments including city and county, but it could not be settled down. The special judicial police officers were weak to punish administrative criminals due to the lack of educational training, and the incidents were mostly dealt with by accusing to national police or prosecution. To overcome this problem, nationwide 17 local governments have introduced special judicial police investigator system in the level of metropolitan city hall or provincial government from 2008 to 2014, and have reinforced the role under the authorization of mayor and province governor. Special judicial police has a specificity of exposing administrative criminal as administrative law violator and of investigating and punishing under the prosecution’s direct. Based on this, this thesis analyzes the problem of Seoul Special Judicial Police System that most lively runs Special Judicial Police System in the level of local government and tries to find the improvement plan. Especially, this thesis dealt with the operation condition and development plan of Seoul Special Judicial Police Organization and offered development plan. This thesis brought six development plans. First, increasing the manpower of livelihood judicial police. Second, self-defense equipment depending on job enlargement of loan company. Third, livelihood judicial police in district office dispatched for duty execution of livelihood judicial police. Fourth, increasing the recognition of the officer in high-ranked position about livelihood judicial police system. Fifth, the difficulty of the duty due to the lack of cost. Sixth, highlighting the need of improvement plan about the reinforcement of educational training.

해방 후 우리나라에 처음 특별사법경찰제가 도입된 것은 1956년이다. 시군구를 비롯해 중앙부처 기관들과 지방자치단체에 이 당시부터 활발하게 특별사법경찰제 도가 도입되었지만 활성화되지는 못했다. 특별사법경찰들은 교육훈련의 부족으로 인해 직무상 적발되는 행정범들을 처벌하는데 미약했고 대부분 국가경찰이나 검 찰에 고발하여 처리되는 경우가 많았다. 이 문제를 극복하고자 전국 17개 광역단 위의 지방자치단체들은 2008년부터 2014년 사이에 광역시청 및 도청 차원에서 전문 특별사법경찰 수사관제를 도입하여 시도지사 직속으로 기구를 발족시켜 역 할을 강화해 나왔다. 특별사법경찰은 행정법 위반자인 행정범들을 직무상 적발하 여 검찰의 지휘를 받으며 조사하고 처벌하는 수사업무를 겸하고 있는 특수성을 지 니고 있다. 이를 바탕으로 본 논문은 광역지방자치단체 차원에서 가장 활발하게 특별사법경찰제도를 운영하고 있는 서울특별시 특별사법경찰제도의 문제점을 분석하고 그 개선 방안을 찾아보고자 시도하였다. 특히 본 논문에서는 서울시 특별사 법경찰단의 운영실태와 발전방안에 관해 살펴보고 개선방안을 제시하였다. 본 논문에서 발전방안이 필요하다고 제기한 것은 다음과 같이 여섯 가지인데, 이를 소개하면 다음과 같다. 첫째, 서울시 민생사법경찰 수사인력의 증원, 둘째, 대부부업 분야의 직무확대에 따른 호신장비, 셋째, 민생사법경찰 직무수행을 위해 서울시에 파견된 구청 민생 사법경찰, 넷째, 민생사법경찰제도에 대한 서울시 고위직의 이해도 향상, 다섯째, 수사비 미비로 인한 직무의 어려움, 여섯째, 교육훈련의 강화 등에 관해 개선방안 을 제시할 필요가 있음을 강조한 것이 바로 그것이다.
