It may be the absolute proposition that the customs as well as practices in the marine transport must be reflected in the marine cargo insurance clauses. In the international trade, goods usually fall into one of two classifications: the first being bulk goods and the others being container goods, the rate of which has been continuously increased in the marine transport. The container goods are safer than the non-container goods and the full container ships are now one of the safest ships in the process of marine transport. In the marine transport of the full container ships of container goods, there may be the great decrease in the frequency of risk and the severity of loss, and may be founded many impractical clauses of cargo insurance. So there must be the strong needs for new clauses in marine cargo insurance. Under the now marine cargo form of policy there are three basic sets of clauses: Institute Cargo Clauses A, Institute Cargo Clauses B and Institute Cargo Clauses C. These clauses were based on the old Lloyd’s S.G. Policy as a model form to the Marine Insurance Act 1906 and could not reflect the new customs and practices of the transport of container goods of full container ships. By way of showing example for the only the container goods of the full container ships Institute Container Cargo Clauses(tentative named) are established : these tentative clauses are based on Institute Cargo Clauses A, and comprised of 13 articles.

국제운송에서 적용되는 적하보험약관은 협회적하약관으로 이 약관은 A약관, B약관 및 C약관을 기본으로 하고 그 밖의 여러 부대약관으로 구성되어 있으며 화물의 종류에 상관없이 적용된다. 오늘날 국제운송화물은 컨테이너화물과 벌크화물로 구분되는데 특히 공산품은 대부분 컨테이너에 적입 운송되고 있다. 그런데 컨테이너화물은 벌크화물에 비해서 위험발생빈도나 손실발생규모가 상대적으로 매우 낮은 편이다. 이에 본 연구는 컨테이너전용선에 적재된 컨테이너화물에만 독점적으로 적용되는 협회컨테이너적하약관(가칭)을 현행 협회적하약관 A약관을 기본으로 하여 시험적으로 제정하였다. 그 결과 협회컨테이너적하약관(가칭)은 13개의 조항으로 구성될 수 있으며 그 동안 제기되어 왔던 협회적하약관의 복잡성을 해결하고 피보험자들도 적하보험계약 체결을 혼동 없이 체결할 수 있을 것으로 기대된다.
