The purpose of this paper is to examine the effect of regime types which is the product of constitutional design on party organizations and behavior, focusing on the issue of leadership election and responsibility in the party. For this purpose, this paper analyzes how the separation of powers, which is the essential property of the presidential system, affects these two problems through two types of agency losses: adverse selection and moral hazard. The results of the analysis are as follows. First, the nature of separation of powers inherent in the presidential system makes the political party more favorable to the outsider, who is more likely to be elected than the insider who is faithful to the organization and ideology in the process of leadership selection in the party. This is due to the fact that the origin of the executive in the electoral sphere depends mainly on the plebiscitary nature of the presidency, which results in an increase in adverse selection and a weakening of the party organization. Second, the nature of separation of powers is that the operation of the executive in government sphere are made by the president alone regardless of the political party(parliament), resulting in the absence of democratic control and the weakening of accountability within the party. From a democratic point of view, it strengthens the elitist character and moral hazard of politics that is difficult to control.

이 논문의 목적은 헌법디자인의 산물인 체제유형이 정당조직과 행태에 미치는 영향을 당내 리더십 선출 및 책임성의 문제에 초점을 맞추어 살펴보는 데 있다. 이를 위해 본 논문은 대통령제의 본질적 속성이라고 할 수 있는 권력분립이 이 두 가지 문제에 어떻게 영향을 미치는가를 대리손실(agency losses)의 두 유형인 역선택(adverse selection)과 도덕적 해이(moral hazard)를 통해 분석한다. 분석 결과는 다음과 같다. 첫째, 대통령제에 고유한 권력분립적 속성은 당내 리더십 선출 과정에서 정당으로 하여금 조직과 이념에 충실한 당내 후보(insider)보다는 당선가능성이 있는 당외 후보(outsider)를 더 선호하도록 만든다는 것이다. 이는 선거영역에서의 집행부의 기원이 주로 대통령직의 국민투표제적(plebiscitary) 성격에 의존한다는 사실에 기인하는 것으로, 그 결과는 역선택의 증가와 정당조직의 약화로 귀결된다. 둘째, 권력분립적 속성은 정부영역에서도 집행부의 운영이 정당(의회)과는 무관하게 대통령 단독으로 이루어짐으로써 민주적 통제의 부재와 당내 책임성의 약화를 초래한다는 것이다. 민주주의적 관점에서, 그것은 통제하기 어려운 정치의 엘리트주의적인 성격과 도덕적 해이를 강화시킨다.
