private information has so wide a spectrum related to respectful profit, from pure private character of information absolutely forbidden its distribution to public character of information wholly permitted its distribution. So it's necessary to develop detailed and complicated legal theory. Herewith I make it known concept and constitutional grounds of privacy right, right of management for his/her own information and right to be forgotten, and seek a solution of conflict with other basic rights through constitution interpretation when right to be forgotten is admitted as a basic right guaranteed by constitution. Lastly I grasp the real problem and seek for alternative solution accompanied by the realization of right to be forgotten.

개인정보에는 인격적 이익과 관련되는 매우 폭넓은 스펙트럼(spectrum)을 가지고 있어 유통이 절대적으로 금지되는 순수한 사적 성격의 정보에서부터 유통이 전면적으로 허용되는 공적정보에 이르기까지 다양한 성격을 가지고 있어 구체적이고 복잡한 법리의 전개가 필요하다. 이를 위하여 우선 프라이버시권, 자기정보관리통제권, 잊혀질 권리의 개념과 헌법적 근거를 밝히고, 다음으로 잊혀질 권리가 헌법상 보장되는 기본권으로 인정될 때 다른 기본권과의 충돌에 대하여 헌법해석을 통한 해결방법을 찾아보고, 마지막으로 잊혀질 권리의 실현에 따르는 현실적 문제점 및 대체적 해결방안을 모색해 보았다.
