Korean housing policy has various problems related to residence stability. The perception that the existing housing policy is in need of a fundamental change is spreading due to the environmental change of the housing market. Indeed, the legislative policy on housing should be promoted in line with environmental changes while revising the ‘supply side’ housing policy, which was introduced during the period marking an excessive boom of the housing market, and absolute shortages of housing inventory in the past. Also, the housing policy has put emphasis on housing price stability while repeating regulation strengthening and deregulation as well as supply expansion by differing in the keynote of policy every time there is the governmental replacement. However, the follow-up housing policy should be converted in the direction of promoting residence stability through the qualitative switch of housing policy, supply expansion of public rental housing, re-examination of price regulation of apartments, transfer of the three laws related to real estate under the jurisdiction of the Ministry of Justice to the Ministry of Land, Infrastructure and Transport, and actualization of the Clause on the right to housing in time of the revision of the Constitution, etc. in line with the housing market environment where possession and residence continue to exist. In addition, required is a legislative-policy-based examination about how to include studio apartments, and accommodations for applicants for examinations where a 1~2 member household lives as practical housing, and how to properly manage them in light of the living culture circumstances of the times where a 1~2 member household is transformed into a standard household. Hereupon, this study looked into the structural change of the housing market, Housing Act, and related policies, etc., and made a proposal from the eyes of a publicist with focus on the legislative task to be rationally improved in the follow-up housing policy.

우리나라 주택정책은 주거안정 등과 관련한 다양한 문제를 안고 있다. 주택시장 환경변화로 기존 주택정책은 근본적인 변화가 필요하다는 인식이 확산되고 있다. 과거 주택시장 과열기, 주택재고가 절대적으로 부족하던 시대에 도입된 공급자 중심의 주택정책은 환경변화에 맞게 입법정책이 추진되어야 한다. 또한 주택정책은 정부교체기마다 그 정책기조를 달리하여 규제강화와 규제완화 및 공급확대를 반복하면서 주택가격 안정화에 중점을 두었다. 그러나 향후 주택정책은 소유와 거주가 상존하는 주택시장 환경의 변화에 맞추어 주택정책의 질적 전환, 공공임대주택 공급확대, 분양가상한제 재검토, 법무부 소관의 부동산 관련 3법의 국토교통부 이관, 헌법 개정시 주거권 조항 구체화 등을 통해 주거안정을 도모하는 방향으로 전환해야 할 것이다. 또한 1〜2인가구가 표준가구로 변모하고 있는 생활문화 시대상황을 고려하여 1〜2인가구가 주로 거주하는 오피스텔, 고시원 등을 어떻게 실질적인 주택으로 편입하여 적절하게 관리할 것인가에 대한 입법정책적 검토가 요청된다. 이에 본 연구에서는 주택시장의 구조변화 및 주택법 ․ 정책을 살펴보고, 향후 주택정책에서 합리적으로 개선되어져야 할 입법과제를 중심으로 공법학자의 시각에서 제언하였다
