This study aims to confirm literature of advanced researches on Social Welfare Responsibility, ideology of welfare for the disabled, their human rights, change in paradigm of welfare for the disabled and the disabled residential facilities, to analyze the cause of human rights violations and abuse of the disabled at the disabled residential facilities by the employees according to the Disabled Persons Welfare Act and the Disabled Persons Welfare Facilities Information, to achieve original purpose of the disabled residential facilities to make happy life of the disabled and then, to suggest basic data to take social welfare responsibilities for the disabled using the disabled residential facilities. The priority method to prevent human rights violations and abuse of the disabled is for people to have continuous interest in the disabled residential facilities, to show praise and encouragement on good deed and to make the facilities promptly correct their wrongdoing, and to practically amend assignment criteria of employees at the disabled residential facilities to minimize their physical and business stress. And, it is required to embody formation of human right protector group so that it may serve its original purpose to prevent and to early discover human rights violations and abuse of the disabled. It is necessary to implement obligatory CCTV installation, change of human right status investigation method, improvement of qualification of employees at the disabled residential facilities, education to enhance employees quality and specialty, establishment of independent delivery system of the Ministry of Health-Welfare, and strengthening of competence of leadership manager and administrator of the facilities in order to solve continuous human rights violations and abuse of the disabled at the disabled residential facilities and then, they may take social welfare responsibilities.

본 연구에서는 장애인거주시설의 근간이 되는 사회복지시설의 책임, 장애인복 지의 이념, 장애인 인권, 장애인복지 패러다임의 변화, 장애인거주시설에 대해 선행연구 등의 문헌들을 확인하고, 장애인거주시설에서 발생되고 있는 종사자에 의한 이용장애인 인권유린과 학대가 이루어질 수 있는 원인을 장애인복지법과 장애인복지시설 사업 안내를 분석하고 대안을 제시함으로써, 이용장애인이 행복 한 삶을 살아갈 수 있도록 기능을 해야 하는 장애인거주시설 본연의 목적을 달성 해 이용장애인에 대한 사회복지적 책임을 다할 수 있는 기초자료를 제공하고자 한다. 인권유린과 학대를 예방할 수 있는 방법은 우선은 모든 국민들이 장애인거 주시설에 대해 지속적으로 관심을 가지고, 시설이 잘하는 것은 칭찬과 격려를 해 주고 잘못한 것이 있으면 신속히 시정해 나갈 수 있도록 해주는 것이 최우선이 고, 장애인거주시설 종사자 배치 기준을 현실적으로 개정하여 종사자들이 신체 적, 업무적 스트레스를 최소화할 수 있도록 해주어야 한다. 그리고 인권지킴이단 구성의 현실화로 인권지킴이단이 본 목적대로 기능을 잘하여 장애인 인권유린 및 학대 예방 및 조기 발견이 될 수 있도록 해야 할 것이다. CCTV 설치의무화, 인권실태조사 방법의 변경, 시설에 종사하는 종사자들의 자격제도 개선 및 종사자 자질과 전문성 향상을 위한 교육, 보건복지부 독자적 전달체계 구축, 시설장의 리더십과 관리자로서의 기능 발휘할 수 있는 역량강화가 되어야 계속적으로 일 어나고 있는 장애인거주시설의 인권유린 및 학대를 해결하여 사회복지적 책임을 다할 수 있을 것이다.
