재난과 심리적 외상 - 세월호 사건을 중심으로

This study explored psychological effect and psychological trauma due to accidents focusing on Sewolho accident that happened in April 16th, 2014 among man‐made disasters. The disaster, an abnormal and percussive event may psychologically affect every victim of the disaster, and victims of a disaster may show various responses such as emotional‐, cognitive‐ and behavioral‐response. In particular, as for psychological effect regarding coping measures, man‐made disasters, which accompany social conflicts and splits may produce a maleficent psychological effect the more seriously than natural disasters. Psychological and behavioral responses that victims of a disaster show in an early stage are regarded as normal ones, and when there is a proper implementation of crisis intervention, most of them could be rehabilitated unaffectedly. However, without a proper implementation of crisis intervention on the disaster, it can be left as a psychological trauma which may result in various mental disorders including post‐traumatic stress disorders that disaster victims should suffer from. Although Korea began to operate the Disaster Mental Health Support Center according to the disaster psychological support law legislated in 2004, there has been no practically established professional system for psychological support in reality. At the time of the occurrence of Sewolho accident, there was no implementation of professional crisis intervention or psychological support, and still any support and/or problem solving are in delay under pertinent political and social situations. For over 2 years since then, victims and disaster‐bereaved families have risen to the truth commission on the disaster and now the psychological status of the victims is significantly serious in that there hasn’t been any settled truth commission that is a prerequisite for psychological rehabilitation with no progress towards the stages of rehabilitation and restoration. It is simply hoped that the situation that they may be supporters each other in fighting together with victims and disaster‐bereaved families, could be an experience of “growth after traumatic experience” as the basis of psychological rehabilitation and restoration.

본고에서는 인간에 의한 재난 중 2014년 4월 16일 발생한 세월호 사건을 중 심으로 사고로 인한 심리적 영향과 심리적 외상에 대해서 고찰해 보았다. 재 난은 비정상적인 충격적인 사건으로 재난피해자 모두에게 심리적인 영향을 미치고 재난피해자는 다양한 정서적, 인지적, 행동적 반응을 보인다. 특히 대 처와 관련한 심리적 영향을 보면 자연재해보다 사람에 의한 재난의 경우 사 회적 갈등과 분열이 발생하면서 심리적으로 더 악영향을 미친다. 재난피해자 들이 보이는 초기의 심리적, 행동적 반응들은 정상적인 반응으로 위기개입이 적절히 실행되면 대부분은 자연스럽게 회복할 수 있다. 그러나 이러한 위기 개입이 적절히 실행되지 않을 경우 심리적 외상으로 남아 재난피해자들이 외 상후 스트레스 장애를 비롯한 다양한 정신장애로 고통을 받을 수 있다. 한국 은 2004년 제정된 재난심리지원법에 따라 재난심리지원센터가 운영되고 있 었으나 실질적으로 전문적인 심리지원체계가 확립되지 않은 상황이었다. 세 월호 사건이 발생했을 당시 전문적인 위기개입 및 심리적인 지원이 실행되지 못하였고 정치・사회적인 여건으로 지원 및 문제해결이 지연되고 있는 상황 이다. 이 년여가 지난 현재까지 생존자 및 유가족들은 진상규명을 위해 투쟁 하고 있는 상황으로, 심리적인 회복의 기본 전제인 진상규명마저 해결되지 않은 상태로 회복 및 재건단계로 진전하지 못하고 있으며, 이들의 심리적인 상태는 매우 우려스러운 상황이다. 다만 피해자 및 유가족이 함께 투쟁하면 서 서로 지지자 역할을 하는 상황이 ‘외상경험 후 성장’의 경험으로 심리적 회복 및 재건의 바탕이 되기를 희망 해 본다.

    ‘법률’이 그 기능을 발휘하기 위해서는 그 사회구성원들이 ‘법률’을 ‘법’으로서 받아들일 때만이 가능 한 것이다. “나쁜 법률”은 아무리 치장을 하고 포장을 해도 “나쁜 법률”일 수밖에 없고 그러한 '법률'은 ‘법’으로서의 기능을 하지 못하고 사회 구성원들로부터도 ‘법’으로서 인정을 받지 못하게 되는 것이다. 지금까지 우리나라는 매우 많은 경우에 있어서 “나쁜 법률”을 포장하고 치장하여 ‘법률’도 ‘법’이라는 이름아래 사회구성원들에게 ‘법’으로서 받아드리도록 강요하여왔고, 그 결과 이를 거부하는 사회구성원들 사이에 심각한 갈등을 겪어왔다. 즉, ‘법률’이 “좋은 법률”일 경우에만 사회구성원들은 그 ‘법률’을 ‘법’으로서 받아드릴 수 있는 것이다. 한국입법정책학회는 “좋은 법률”만을 만들어야 하는 입법자를 지원하는 것을 그 구체적인 목표로 하고 나아가 ‘법’에 관한 법이론적 연구 및 입법론에 관한 연구를 수행하며 이와 관련하여 철학 및 어학 등 입법과 관련한 다른 영역과도 활발한 교류와 협력을 하여 대한민국의 입법제도 및 입법문화의 형성 및 발전의 기초를 다지고자 설립하였다.
