The purpose of the study is to explore the contents of guarantee for making educational right and public education indicated in the Constitution Law and Educational Basic Law for the normalization of public education substantial and provide some implications for improving educational legislation. For this, the contents of educational right and the substantiality of public education guaranteed by the Constitution Law and Educational Basic Law were examined by the viewpoint of educational value. We recognized the basis of public education as ‘equality’ and ‘publicity’ and analyzed them comparing with the value such as ‘autonomy’ and ‘competition’. Main results of the study are as follows. Firstly, the Constitution Law recognizes ‘publicity’ and ‘equality’ about public education. And it shows that ‘autonomy’ and ‘freedom’ must be personal right within the range of keeping publicity and equality. Secondly, the provisions of the Educational Basic Law involving the Constitution Law and the educational value of the Constitution Law identify that ‘human dignity and value’ are pursued as happiness right that are guaranteed as right for getting equal education. Thirdly, the Constitution Law and Educational Basic Law guarantee the opportunity of ‘right for getting education’ and ‘the value of non-discriminatory educational opportunity’. Finally, the Constitution Law and Educational Basic Law guarantee the public benefit that learner should have putting the benefit of ‘publicity’ that ‘all of the people’ should have as educational right in the statutory form.

공교육 정상화를 위해 헌법 및 교육기본법에 나타난 교육권과 공교육 내실화를 위한 보장 내용을 고찰하고 나아가 교육법제의 개선을 위한 시사점을 제공하는 것이 본 연구의 목적이다. 이를 위해 헌법과 교육기본법에 보장된 교육권과 공교육 내실화 내용을 교육가치적 관점에서 고찰하였다. 공교육의 기초를 ‘평등성’과 ‘공공성’으로 인식하고 ‘자율’ 및 ‘경쟁’이라는 가치와 대비하여 분석하였다. 본 연구의 주요 결과는 다음과 같다. 첫째, 헌법은 공교육에 대하여 공공성과 평등성을 인정하고 있으며, 무엇보다 ‘자율과 자유’도 공공성과 평등성을 지키는 범위 내의 개인적 권리여야 함을 보여 주고 있다. 둘째, 헌법과 헌법의 교육적 가치를 내포하고 있는 교육기본법의 규정은 ‘인간의 존엄과 가치’가 행복적 권리로 추구되고 이는 균등한 교육을 받을 권리로 보장되는 것으로 확인되었다. 셋째, 헌법과 교육기본법은 ‘교육받을 권리’의 기회와 ‘차별 없는 교육 기회의 가치’를 보장하고 있다. 마지막으로, 헌법 및 교육기본법은 ‘모든 국민’이 교육의 권리로 누려야 할 ‘공공성’의 혜택을 명문화하여 학습자가 누려야 할 공공의 혜택을 보장하고 있다.
