The Article 1 Constitution declares the principle of democratic-republic state, and the doctrine that sovereignty rests with the people. Meanwhile, the Article 25 makes clear that every citizen shall have the rights to take public office as provided by law. In this paper, the author made an attempt to demonstrate that the rights to hold public office has the nature of basic civil rights in view of traditional principle of Republic, and the nature of assuring the civil participation, which takes important position in the democratic value. In addition to these institutional aspects, the author emphasized that the public service is the significant instrument to confirm the civil identity, so that it should not be traded in the market, nor distributed arbitrarily on the basis of Aristotle, John Rawls, Michael Walzer, and Dworkin.

헌법 제1조는 민주공화정의 원리 및 주권재민의 원리를 선포하고 있고, 제25조에는 모든 국민에게 법률이 정하는 바에 따른 공무담임권이 보장된다는 점을 천명하고 있다. 이 글을 통해 필자는 공무담임권은 전통적인 공화정 원리에 따른 시민으로서의 기본권적 성격을 갖고 있고, 아울러 시민 참여를 보장하는 기능으로서 민주주의 원리에 핵심을 차지하고 있다는 점을 밝히고자 하였다. 그리고 이러한 제도적 측면 외에 공직은 시민적 정체성 확인의 주요한 수단이기도 하며, 따라서 시장에서 거래되거나 자의적으로 분배되어서는 안 되는 사회적 자원임을 아리스토텔레스, 롤스, 왈쩌, 드워킨 등을 통해 살피고자 하였다.
