This study is aimed at providing critical study regarding South Korea’s conditions of National security violator, investigation, and court’s decisions. This study points out that dangerous power have attacked cyber space by using rapid technology progress, whereas jurisdiction take action very inefficiently in the light of domestic and foreign cases and analysis. This problems arise from not only society unfavorable atmosphere about security activity but also unclear and inflexible legal system. Especially, the study points out that the expiation of dangerous power against national security can lead to link between public safety offender and foreign terrorist. It is related to application and ripple effect of SNS (Social Network Service) as well. On top of that, this study provides contemporary opinion place in order to fight against dangerous group that can harm national security, emphasizes the need of regulations, and alternatives for infringement on privacy rights. Finally, the thesis provides opinion regarding the way of extending admissibility of evidence through communication report and limitation. Furthermore, it argues that the law and regulation should be revised so that it adjust changing security environment. It provides alternatives about possibility of regulation concerning specific preliminary except from penalty and scope of admissibility of evidence as well.

본 논문은 통계자료를 통하여 우리나라의 안보사범의 현황과 수사기관의 수사여건, 법원의 입장 등에 대한 비판적 검토를 수행하였다. 현재 국가안보의 위해세력이 인터넷과 정보통신망의 비약적인 기술발전을 악용하여 사이버 공간에서도 활동영역을 확장하고 있는 반면에 사법기관에 의한 대응은 여전히 비효율적이라는 점을 지적하였다. 이러한 문제는 보안활동에 대한 비우호적인 사회분위기뿐만 아니라 증거능력의 인정에 있어서 일반 형사범과 안보사범을 동일하게 취급하고 있고, 급속하게 변화하는 안보환경의 대응하기에는 미비한 현행법의 경직성에 대하여 지적하였다. 특히 온라인상에서의 국가안보 위해세력의 확대는 공안사범뿐만 아니라 해외 테러세력과의 연계도 문제될 수 있으며 특히 최근 급신장하고 있는 SNS의 활용과 그 파급력과도 관련이 있다는 점도 지적하였다. 본 논문은 이러한 문제점을 해결하기 위하여 온라인 공간에서 안보위해 세력의 확산을 경계하기 위한 시론적 논의의 장을 열었고, 그 규제의 필요성을 역설하였으며 그 과정에서 충돌될 수 있는 프라이버시 침해와의 균형성에 대해서도 대안을 제시하였다. 뿐만 아니라 사이버 안보활동의 기본법 제정의 필요성에 대해 역설할 뿐만 아니라 일정한 범위 내에서 통신제한조치의 허가 요건이 전향적으로 검토될 필요성이 있음을 검토하고 특정행위에 있어서 가벌성의 전치화에 대해 검토하였다. 더 나아가 빅데이터, 사물인터넷 등에 의해 안보위협이 발생할 수 있는 경우를 검토하고 그에 대한 대응방안 수립의 필요성을 역설하였다.
