It needs the multi-level considerations pertaining to the procedure for the dispersal of the assembly. First of all, researcher suggests the theory of policing standards which is consisted of three axes such as the international norms, domestic norms and human-oriented policing. This theory creates the 3 dimensional space for the framework of the research and analysis. This theory does not mean the arbitrary law enforcement in policing, but manufacture the successful and well-taylored standards for policing in detail. Then, in view of the framework of policing standards, the dispersal of the assembly in Korea has various kind of problems. Korean domestic law does not include the international human rights law properly. Although Water canon is proved harmful for many participants of the assembly, its guidelines even does not include the principle of necessary minimum. The enforcement ordinances or guidelines which may infringe the people’s rights are not established by fare and transparent ways. Korean Police has made many ordinances and guidelines for the assembly discretionally. Moreover, there are very few research for the evidenced based policing. Therefore, researcher suggests that new committee should have the rights for decision of the risk evaluation in the dispersal of the assembly in order to solve these problems and civil parts should take part in the legislation procedure for the ordinances and guidelines about the assembly.

집회시위 해산 절차에 대하여 국내 규범과 국제 규범 그리고 인간 지향 경찰활동을 각각의 축으로 하는 경찰업무기준론을 도식화하고 그동안 법률이나 정책학, 사회학 등으로 흩어져있던 연구를 통합하여 보았다. 여기서 경찰업무기준을 만들겠다는논리는 경찰 자의에 의한 법집행을 말하는 것이 아니라 국내 규범을 바탕으로 국제규범과 외국 경찰 사례, 그리고 인권 가치와 법과학/법공학의 연구 성과를 반영하여경찰의 업무기준을 세밀하게 제대로 만들겠다는 취지이며 한 걸음 더 나아가 현장에서의 법집행 분야도 발전시키는 목적도 겸하고 있다. 경찰업무기준론의 틀로 불법 집회시위 해산 절차를 검토하여 본 결과 국제법 규범에서는 ‘해산은 최후의 수단’, ‘타인의 불법행위로 전체 시위대의 집회의 자유가 침해되어서는 안된다’는 등의 선언적규정이 우리나라의 국내법규에 반영이 되지 않았음을 발견할 수 있었고, 독일 경찰의집회 해산 사례를 살펴보면서 집회 해산과 위해성 장비의 사용은 불가분의 관계에있음을 알게 되었다. 인권과 법률의 조화를 위해 합법성과 비례성의 원칙을 검토하여본 결과 훈령/규칙이나 내부 지침이라 할지라도 시민의 참여 하에 공정하고 투명하게 제정되어야 한다는 사실도 배울 수 있었다. 또한 현재 우리나라에서는 거의 찾아보기는 힘들지만 과학적 연구를 통해 집회시위 관리정책의 발전 가능성을 엿봤다. 이렇게 잘게 쪼개진 개선안들을 다시 모아서 집회시위 해산에 이르는 위험 즉, 공공의안녕과 질서에 명백하게 초래된 위험 여부를 판단할 새로운 ‘평화적 집회시위 보장위원회’를 설립하여 운영할 것을 제안하였다. 한편, 행정규칙이나 내부 지침이라 할지라도 국민의 권리에 침해를 가할 수 있는 경우라면 시민의 참여하에 공정하고 투명하게 제정할 것을 제안하였다.
