The aim of this article is to analysis on the means of the enactment of the Refugee Act of Korea and the systems or rules which can invade right of refugee in the Refugee Act. And also the aim of this article is to suggest how put the focus on education of human right for refugees. The first contents of this research were illuminate essential recognition requirements for concept of refugee and were illuminate the status of the refugees and the type of refugees. The second contents of this research were analyse the process and means of the enactment of the Refugee Act of our nation in the three kind of era. The third contents of this research were analyse the contents of the Refugee Act of Korea and were indicate the institutional problems of the Refugee Act of Korea in the protection of human rights. In its final analysis, there are five problems of the Refugee Act of Korea were suggested and also were suggested how have to do education of human right for refugees.

본 연구는 우리나라 난민법 제정이 가지는 의미와 난민법상 난민인권이 침해될 수 있는 제도나 규정은 어떤 것인지를 검토하여 문제점을 밝히고 인권교육이 어떻게 이루어져야 하는가에 관한 연구이다. 이를 위하여 난민의 개념 구성에 있어 핵심적인 인정요건과 이를 바탕으로 한 난민의 유형을 제시하면서 이들의 지위를 살펴보았다. 그리고 우리나라 난민법의 등장을 3가지 기준으로 시기를 나누어 분석하고 난민법 제정의 의미를 제시하면서 난민법의 주요내용을 구조적으로 분석하고, 그에 따른 인권보호적 차원에서의 제도적 문제점을 8가지로 나누어 제시하였다. 결론적으로 난민법의 제도적 문제점을 다섯 가지로 정리하여 제시하였고, 인권교육의 초점이 어디에 맞추어져야 하는지를 제안하였다.
