Since the standard applied for Act on Acquisition of and Compensation for Land, etc. for Public Works Projects in 1970s of development era has not been adjusted till today according to the social and economical changes, it is common knowledge that there is a aspect of not corresponding with raised sense of entitlement regarding the property rights of general public. Especially, the calculation of land compensation based on the officially assessed reference land price has caused a problem against the principle of just compensation in the subparagraph 3, Article 23 of Constitution of the Republic of Korea due to deficiencies in law and system. Therefore, the calculation method of compensation amount based on the officially assessed reference land price shall be needed to be reformed in a direction to realize the principle of just compensation in the Constitution. The purpose of this thesis is to examine legal issues in relation with whether the calculation of compensation in the Article 70 of Act on Acquisition of and Compensation for Land, etc. for Public Works Projects based on the officially assessed reference land price, has been in violation of “just compensation” of subparagraph 3, Article 23 of Constitution.

우리의 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」은 1970년 대 개발연대에 적용되었던 기준을 경제ㆍ사회적 변화에 맞게 수정하지 못한 채 오늘에 이르다 보니 일반국민의 재산권에 대한 높아진 권리의식에 부합하 지 못하는 측면이 있는 것이 주지의 사실이다. 특히 표준지공시지가 기준 토지보상액 산정은 법제도적 결함으로 인하여 헌법 제23조 제3항의 정당보상 원칙에 반하는 문제점을 초래하고 있다. 따라 서 표준지공시지가를 기준으로 하는 보상액산정방식은 헌법상 정당보상원칙 이 구현될 수 있는 방향으로 개편이 필요하다. 본 논문은 현행「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」제70조에서 보상금 산정을 표준지공시시가를 기준으로 하는 것이 헌법 제23 조 제3항의 ‘정당한 보상’에 위배되는지 여부와 관련한 법적 쟁점을 고찰하는데 목적이 있다.
