"special law on Arrangement of construction work interruption long left the building." also has just 14 articles, It’s too hard to apply on case. therefore it need to develop a system maintenance of deserted building that refer to foreign Case.

공사가 중단된 건물이나 농촌의 폐교, 도시 내 빈집 등 사용되지 않는 건축물들은 장기간 방치되어 자연 경관을 훼손하고 각종 범죄 장소로 이용될 우려가 크다. 특히 정비사업지구의 개발이 지연되면서 다수의 폐·공가가 발생하고 있는 추세여서 이러한 지역들이 우범지대로 전락할 우려가 더욱 높아지고 있다. 이와 관련하여 국가가 직접적으로 개인의 재산에 개입할 수 있는 근거가 있는 법령은 「공사중단 장기방치 건축물의 정비 등에 관한 특별법」뿐이고, 다른 관련 법령에서는 철거범위 내에서만 관여할 수 있어 미사용 건축물의 활용방안이 미흡한 실정이다. 「공사중단 장기방치 건축물의 정비 등에 관한 특별법」 또한 전체 조문이 14개에 불과하여 실제로 많은 사례에 적용하기에는 한계가 있을 것이므로 추가적인 연구가 필요하다. 이에 해외사례를 참고하여 방치건축물에 대한 제도적 정비가 필요하다 생각된다.
