The massive maritime area has been incorporated into the maritime jurisdiction of Korea through the adoption of straight baselines around the coast area, and the right of innocent passage is allowed to a foreign-flag vessel through the area. This mechanism potentially constitutes a threat to the interest, safety and security of coastal state. Thus, the innocent passage of foreign-flag vessel through a internal waters needs to be properly regulated and controlled. Thus, this study examines the significance of internal waters under the international law and national law and the current status of national internal waters under national law. It also identifies the national legal mechanism for managing of internal waters. Especially, this study makes certain of the problems related with the innocent passage of foreign-flag vessel, and examines and proposes the way of improving the legal system in relation with internal waters, the way of enacting the new legal regime for preparing against coastal property damage, and the way of improving the national ships’ routeing system and etc. to control innocent passage.

우리나라는 직선기선의 채용으로 광범위한 수역을 내수로 편입하고 있는데, 동 수 역은 외국선박의 무해통항이 인정된다. 이는 잠재적으로 연안국의 이익, 안전 및 안 보 등에 위협을 구성한다. 따라서 내수에서의 외국선박의 무해통항은 적절하게 규제 및 통제되어야 한다. 이에 본 논문에서는 국제법 및 국내법에 따른 내수의 의의 및 국내 내수 현황 등 을 확인하고, 내수의 관리를 위한 관련 국내법 체계도 확인하였다. 특히, 내수에서의 외국선박의 무해통항과 관련한 문제 상황을 확인하고, 내수 관련 법체계의 정비 방 안, 연안의 재물 손괴 등에 대비한 관련법 제정 방안, 그리고 무해통항 관리를 위한 국내 항로지정제도 등의 정비 방안 등을 검토․제시하였다.
