This study investigates the legal nature of the system of recovering the fraudulent gains with additional levies equivalent to the fraudulent gains when the opposing contractor submits data containing false or unlawful cost accounting to the government in purchase contract of weapon system, one of government procurement contracts and the current study also examines the condition and the effect of the system of recovering the fraudulent gains with additional levies based on the legal nature in view of civil law. Through accounting for the exact principle of civil law about the above-mentioned system, the purchase contract of weapon system will operate relevant to civil law.

본 논문은 민사법적 관점에서, 정부조달계약의 일종인 무기체계 구매계약에 있어서 계약상대자가 허위의 원가 자료를 정부에 제출하였을 때 원가 차액 및 그에 상당하는 가산금을 정부에 환수하도록 하는 ‘부당이득 및 가산금 환수 제도’의 법적 성격을 알아보고, 그 법적 성격에 따른 ‘부당이득 및 가산금 환수 제도’의 요건과 효과를 살펴보고자 한다. 위 제도에 관해서 민사법적으로 정확한 법리 설시를 통하여 무기체계 구매계약이 민사법에 부합하게 운용될 수 있을 것이다.
