In this research, I did reference research and qualitative research on the similar sexual crime of the movie “Silenced” which is a crime case of victims of “Gwangju Inhwa School and also brought huge public opinion and anger about sexual crime of vulnerable social group. To research the character of sexual crime of the disabled woman, I have researched through statistics of a lot of organizations which are the national police agency, public prosecutors’ office, sexual violence counselling center and sexual violence counselling center for the disabled woman. I could have know the character of sexual crime through the Film ”Silenced” and researched about it with public statistics data. It showed that the closed environment makes the high chance to get constant sexual crime without distinction of disabled woman or child, The environment is the fundamental factor of sexual crime which makes the crime much easier in the matter of crime occurrence. It showed that the residence form of educational facility and protection facility bring down the monitoring effect to prevent the crime so it makes a constant exposure of crime. it showed that victims are tempted into sex offender’s low level of strategy which are giving them something or waving their hand. This strategy has been used to the child who doesn’t have ability to perceive. On the other hand, sexual crime offender used different plans which are walk them home, giving them something to eat and place to sleep and being a friend through internet chatting first to be familiar with them to tempt the disabled woman. These strategies are more like things in a normal life. It indicates that sense of closeness makes easier to tempt the disabled woman because they are not well socially related and they have wariness to the society. I had some difficulty to find variety research method because of unsegmented statistic data and short accessibility of data to continue the research although I have strong interest for social issue and public opinion of victims of sexual crime the disabled women. I think that open source to search the information about sexual crime and statistics data of sexual crime by the type of disabled people will be useful to improve the legal solution for the victims.

이 연구에서는 사회적 분노와 범죄피해 취약계층의 성범죄 피해에 대한 공론화를 불러낸 ‘광주인화학교’ 사건을 영화화 한 영화 “도가니”를 중심으로 문헌연구와 질적 연구를 시행하였다. 영화 “도가니”를 중심으로 영화에서 나타나는 성범죄의 중독적 특성 요인을 도출 하여 공식 통계와 함께 연구하였다. 장애 여성 피해자들의 취약 요인을 통계 및 언론 사례들을 통하여 논리적 비약을 줄이고, 개인적 차원과 사회적 차원에서의 예방방안 과 대처방안을 모색하였다. 영화를 중심으로 살펴본 폐쇄적 물리 환경 요인은 장애 아동과 여성의 구분 없이 지속적인 범죄 가능성을 높이는 것으로 나타났다. 물리적 환경은 범죄발생에 있어서 실행과 관련한 용이점을 제공해주는 가장 근본적인 요인이라 할 수 있다. 생활패턴에 있어서 집과 마찬가지로 주거지라는 의미를 가진 보호시설 혹은 교육시설의 상시 거 주 형태는 그들로 하여금 범죄를 예방할 수 있는 감시효과를 하락시켜 범죄의 지속 적인 노출로 이어짐을 알 수 있다. 영화 속 가해자의 경우, 장애 아동을 손짓, 먹을 것 등의 단순하고 낮은 수준의 유 인 전략에도 피해자가 혹하게 되는 경우가 나타났다. 이는 장애 여부를 떠나 상황판 단능력이 부족한 아동 등에게 가장 많이 사용되는 전략이다. 특히, 지적 장애 여성의 경우에는 장애 아동만큼의 단순한 수준의 유인전략 보다는 숙식제공, 집으로 데려다 주기, 채팅을 통한 친근감으로 유인 등의 일상생활과 밀접한 유형의 유인 전략을 사 용하는 것으로 나타났다. 장애 여성 성범죄 피해자들에 대한 언론과 사회적 관심은 많지만 실제 연구를 진 행하기 위한 자료에 대한 접근성과 세분화되지 못한 통계자료로 인하여 다양한 연구 방법을 구색하기에 어려움이 있었다. 현재보다 다양한 일정 수준의 정보개방과 장애 유형에 따른 각각의 범죄 통계의 구축은 단순한 연구를 위한 의미보다 실제 관련기 관들의 제도적 개선방안에 있어 활용가치와 틀을 만들 수 있다고 여겨진다.
