현대사회에서 중독 혹은 중독과 관련한 행위는 많은 경우 형법적 문제가 된다. 대 표적으로 마약이나 도박 중독의 경우처럼 중독성이 있는 것으로 여겨지는 행위 그 자체가 구성요건이 된다. 또한 건강을 위협한다. 예를 들어 중독이 심해질수록 뇌가 변하고 손상되면서 심각한 뇌 합병증을 유발한다. 나아가 중독범죄 및 중독문제는 많은 사회적 비용을 유발시키고 있다. 중독은 더 이상 개인의 문제가 아닌 사회 안전을 위협하는 존재가 된 만큼 중독에 대한 인식 개선과 적극적인 예방, 치료는 선택이 아닌 필수이며, 특히 계속해서 새로 운 중독 대상이 생겨나고, 중독에 노출되는 연령대가 점차 낮아지고 있는 만큼 중독 폐해의 심각성을 인지하고, 처벌보다 예방·치료로의 전향적 자세가 필요할 때이다. 본 연구에서는 중독범죄 및 중독문제에 대한 개관함으로써 그 새로운 접근방법으 로서 무용(동작)치료에 대한 그 가능성을 고찰하였다. 이는 중독범죄 및 중독행위에 대한 무용(동작)치료적 접근을 통하여 중독자에 대한 처벌에서 치료와 재활로 전환되 는 계기가 될 것이다.
