Laws associated with the adjustment of investigations conducted from 2012 accelerated he conflict of the police and prosecutors. In this study, the conflict in the form of police and prosecutors over the past year, will provide direction for improvement. First, the theoretical background is as follows. This study examined the concept of the investigation. Investigations associated with the adjustment depends on the range of investigation concept, concepts examined. And, history of past investigations and related adjustments. Second, The Internal investigation, investigation command, investigation controland Code of Criminal Procedure etc, the issues and improve the direction. Importantly, the police and prosecutors should provide the best public order service to the citizens. The enactment of laws and amendments should be developed and future-oriented.

2012년 1월 1일부터 시행되고 있는 「검사의 사법경찰관리에 대한 수사 지휘 및 사 법경찰관리의 수사준칙에 관한 규정」이 1년이 다 되어 가고 있다. 그러나 경찰과 검 찰 양 기관이 기존의 갈등 양상이 지속되고 있어 법률 등의 내용을 검토 및 향 후 개 선방향을 제시 하였다. 이 연구의 이론적 배경으로 수사의 개념, 수사권 조정 논의에 대해 살펴보았다. 수사권 개념의 경우 학자들의 견해가 다른데, 특히 내사 포함 여부 가 문제가 된다. 내사에 대해서는 지난 2011년 6월 20일 국회사법제도개혁특별위원회 에서는 ‘모든 수사에 내사사건은 포함되지 않는다’의 내용이 있음에도 불구하고 내사 를 수사에 포함하여 검찰의 통제를 받는 다는 것은 무리가 있다. 수사권 조정에 대해 서는 그동안 논의 되었던 내용을 연혁적으로 제시하였다. 다음은 「검사의 사법경찰 관리에 대한 수사 지휘 및 사법경찰관리의 수사준칙에 관한 규정」의 문제점으로 입 법취지 반영 미흡, 미흡, 내사 및 입건 등 수사 지휘·통제권의 문제점, 수사중단 ․ 송 치명령의 문제점, 검찰 권한 강화 문제점에 대해 고찰하였다. 법률은 시대적 요구의 반영, 행정기관의 효율적 운영, 국민의 기대 부흥에 따라 개정된다. 경찰과 검찰의 소 위 ’밥그릇 싸움‘으로 비취지는 비생산적인 다툼은 지양하고 국민을 위한 실질적 치안 서비스를 제공하는데 힘을 모아야 한다.
