- Trade transactions as a documentary transaction require the seller to provide goods and documents in conformity with the contract of sale including the commercial invoice to the buyer under international practice and international law such as Incoterms and CISG. Among documents relating to the contract, the commercial invoice is an important document that should be prepared by the seller because it is used as evidence for duties paid for import clearance. In general, providing false information on the commercial invoice causes delays or denies in import clearance. Thus, the seller has to prepare the commercial invoice correctly. Moreover, since the 9.11 attacks, logistics security has been expanding all over the world. In particular, import clearance for exports to the US is very strict, especially, for the commercial invoice in subpart F of CFR 141. To reduce hindrances in import clearance, recently buyers prefer to use DDP terms, which the seller has a responsibility for import clearance. Given this change to avoid trade documentation errors, traders who want to export to the US should prepare the documents thoroughly based on these regulations. Therefore, this study attempts to verify commercial invoice requirements in CFR and to suggest the standard form of pro forma invoice and commercial invoice by analyzing the commercial invoices used in trade with the US.

- 무역거래는 서류거래로 국제관습 및 국제법에서는 매도인의 서류제공의 의무를 규정하고 있다. Incoterms의 매도인의 첫 번째 의무와 CISG 제30조에서는 계약물품의 인도와 함께 상업송장 및 기타 관련서류를 인도하도록 하고 있다. 이렇듯 무역거래에서 상업송장은 수입통관 시 과세증명자료로서 중요한 역할을 하고 있다. 9.11테러 이후 미국을 중심으로 컨테이너화물 보안규정이 강화되고 있는데, 특히 미국의 경우, 수입상품에 대해 미국 연방규정집(Code of Federal Regulations: CFR)에서 서류들의 세부적인 요구사항들을 규정하고 있다. 이 중 본 연구는 수입통관 시 중요하게 검토되는 상업송장의 요건을 미국 연방규정집에서 요구하는 요건에 기초하여 분석하고, 우리나라 수출업자들이 대미 수출시 사용 가능한 상업송장의 표준양식을 제시하였다.
