This paper investigated the changes in the perception about the Japanese Legal System. For conducting this research, the paper examined ‘Sahangrok’ (diaries written by Korean emissaries to Japan) from the end of 16th century to the late of 18th century. The Korean emissaries showed great interest and disharmony about the severe punishment and thorough surveillance system of Japan. They keenly observed the Tokugawa Shogunate (Japanese government) and investigated how (by imposing what kind of law and order) the government had controlled the society. This paper conducted the research by paying attention to this particular point. The paper examined the perception regarding the ‘Punishment system’, ‘Kosatsu’ and ‘Sekisyo’ to study conversion in the awareness about the Japanese Legal System. The result of this study is as follows. Firstly, this paper confirmed that the Korean emissaries had showed negative understanding about the severe punishment system in Japan. This paper also verified the following points. The Korean emissaries had discovered that Kosatsu had played an important role in establishing public security. They also pointed out that Sekisyo had served the dual function of monitoring and being a military fortress.

본고의 목적은 16세기 말엽부터 18세기 후반 사이에 기록된 일본 사행록을 검토하여 일본의 법제도에 대한 인식이 어떻게 변화하였는지를 탐구하는 데에 있다. 일본 사행록에는 일본의 엄격한 형벌제도와 철저한 감시체제에 대한 위화감과 관심이 나타나며, 사행원들은 마침내 도쿠가와 막부가 어떠한 법질서에 따라 사회를 통제하는지 예리하게 관찰하는 데에 이르렀다. 본고는 이 점에 착안하여 연구를 진행한 것이다. 일본의 법제도에 대한 인식의 변화를 살피기 위하여 본고는 다음의 세 가지 사항, 즉 형벌제도, ‘고사츠’(高札), ‘세키쇼’(關所)에 대한 인식을 분석하였다. 분석의 결과는 다음과 같다. 우선 일본 형벌제도에 대한 인식을 살펴 사행원들이 일본의 잔인한 형벌방식을 부정적으로 인식하였음을 밝혔다. 다음으로 사행원들이 ‘고사츠’를 통해 일본의 치안이 유지되었던 사실을 포착하였으며, ‘세키쇼’가 철저한 감시의 기능과 아울러 군사요새로서의 기능을 겸비하였다는 사실도 지적하였음을 드러내었다.
