성범죄 피해아동의 보호방안에 대해서는 그동안 소년법이나 그 밖의 관련법에 의하여 대책이 강구되어 왔다. 그러나 범죄피해자나 혹은 그 증인이 된 아동의 경우 성인과 구별이 없이 성인의 형사절차를 따라야만 하는 것이 그간의 현실이었다. 다행히 최근 아동범죄피해자에 대한 관심이 높아지면서 형사사법절차에서 피해아동에 대한 적절한 보호 방안이 중요한 관심사로 떠오르고 있다. 2012년 8월 ‘나주 초등생 성폭행사건’에서 보듯이 수사기관이 각고의 노력 끝에 범인을 검거했음에도 피해자의 보호와 인권에 대한 고려가 미흡하여 수사기관은 물론 형사사법제도 전반에 대한 비난을 받아왔다. 또한, 형사사법제도의 궁극적인 목적은 국가형벌권의 행사 뿐 만 아니라 가해자와 피해자 사이의 갈등의 해소까지 포함된다는 사실이다. 따라서 형사사법에서 성폭력피해아동에 대한 적극적 관심과 배려는 범죄의 궁극적 해결책으로서 파악해야지 단순히 실체적 진실확인을 위한 보충적 의미로 보아서는 안된다. 결국 이러한 문제제기는 형사사법절차의 운영과정에서 요구되는 피해아동에 대한 권리보호장치의 확대를 포함한 보다 적극적인 피해아동정책의 수립을 위한 가이드라인의 의미를 가지고 있음에도 불구하고, 현행 형사사법체계는 피해아동의 권리보호에 대한 관심과 배려가 부족하다는 점에서 기인한다. 본 논문에서는 먼저 아동성폭력범죄의 정의와 범죄추이 발생 및 현황, 이와 관련되는 개정 법률을 살펴보고 현재 우리나라의 아동 성범죄대응에 관한 문제점 및 개선방안을 검토하여 다양한 각도에서 피해아동을 위한 구체적이고 합리적인 보호방안을 조명해 보고자 한다.
