In regards to the theories or judicial precedents on the social constitutional rights of the Japanese constitution, there has been an ongoing point of view stating that the constitutional provision alone does not ensure legal nature of right that can be guaranteed through trial since the social rights provision such as right to life is not a provision of program or specific rights but a provision of abstract right. In recent theories and rulings in lower court trials, however, theories of specific right are being presented stating that specific payment claim can be made directly to the government based on the Article 25 of the Constitution alone even without legal specification. The purpose of this paper is to discuss the legal nature of right to life in the Article 25 of the Japanese Constitution by analyzing two representative precedents regarding social security of Japan. Based on this, it will review through the social security administrative law viewpoint the possibility of recognizing the beneficiary right or payment request right to receive social security in social security related laws and its legal basis.

일본 헌법의 기본권에 관한 학설이나 판례는 생존권 등 사회권규정은 권리규정이 아니라 프로그램 규정이라든지 혹은 구체적인 권리가 아니라 추상적인 권리를 규정한 것에 불과하여 헌법 규정만으로서는 재판에 의해서 보장될 수 있는 법적 권리성을 가지지 않는다는 견지가 유지되어 왔다고 할 수 있다. 그러나 최근에는 학설과 일부 하급심 판결에서 법률에 의한 구체화 작업이 없더라도 헌법 제25조만을 근거로 직접 국가에 대하여 구체적인 급부청구를 할 수 있다는 구체적 권리성설도 등장하고 있다. 본고에서는 일본의 사회보장에 관한 대표적인 판례 2건을 분석하여 일본 헌법 제25조의 생존권의 법적 성격을 논하고, 이를 바탕으로 사회보장에 관한 개별법에서 사회보장을 받을 수 있는 수급권 내지 급부신청권의 인정 여부 및 그 근거에 관해서 사회보장행정법적 시각으로 검토하는 것을 연구의 목적으로 하고 있다.
