Volunteer custodian in the first treatment of the juvenile delinquent law which is imposed on the juvenile delinquent by juvenile court is outside person who participate in producing protection pubic service related to the adjustment of juvenile environment and correction about juvenile delinguent. These volunteer custodian system which produces bdchanism of protection public service on a surrogate parents, case manage, coordinator and so on which is composed of the familization of juvenile protection, the humanization of juvenile protection and the specialization of juvenile protection which is based on the forensic (judicial) social welfare, the family social welfare and correctional welfare. But the korean juvenile delinguent law system has been based on the judicial bureaucratism for a long time contrary to the japanese juvenile delinguent law system which is based on the forensic social welfare from long ago. The existing study is short of the forensic social welfare, correction welfare and so on. Thus, I would like to explain approach to improve the volunteer custodian system problems which existing studies hase passed over abut it throughout my original view.

위탁보호위원이란 1호 처분이 부과된 소년에 대한 환경조정과 교정이라는 보호공공재의 생산에 참여하는 외부자원봉사자를 말한다. 위탁보호제는 보호의 가족화, 인간화, 과학화를 내용으로 하며 이는 사법복지와 교정복지, 가족복지의 이념을 기초로 한다. 그러나 사법관료제에 기초한 우리의 소년사법은 이미 사법복지로 소년사범을 취급하는 일본과 달리 아직도 행정적 성격이 강한 소년사법으로 되어 있고 이에 관한 기존의 연구들도 미시적 관점에서만 접근하였고 사회복지적 관점이 부족하다. 따라서 본 논문에서는 소년관련법규와 운영실무를 언급하고 기존연구들이 간과한 측면들을 독창적이고 학제적 관점에서 비판하고 독창적인 개선방안을 제시한 바 바로 이점이 기존연구들과의 차이점이다.
