This study aims at investigating the important responses to cyber- bullying in foreign countries. Recently, foreign countries such as U.S and Canada have suggested that get-tough policies and a wide range of discretion in examining cyber-bulling are needed in order to prevent the problematic behaviors of juveniles in online world. A crucial goal of the study is to introduce new reponses of foreign countries toward juvenile cyber-bullying. In particular, the current study will focus on finding the most representative intervention programs and principals to prevent cyber-bullying in Australia, Germany and Taiwan as well as U.S and Canada. Given the fact that prevalence of instant message and cyber- bullying by using smart phone among juveniles in South Korea have rapidly increased, it is significant to review the innovative responses of foreign countries and understand the major concepts to develop effective intervention programs for preventing juvenile cyber-bullying. Furthermore, it is crucial to ascertain what types of intervention programs and polices could be initiated due to the fact that little research regarding the effectiveness of cyber-bulling prevention programs has been conducted in South Korea. In this context, this study will concentrate on summarize up the core values of implementing cyber-bullying programs through the recent literature reviews of foreign countries. This study suggested that “WebQuest” in Taiwan and “Media Heroes” in Germany program can be applied to South Korea because they enhance the fundamental knowledge of cyber-bullying prevention strategies to juveniles and help students learn social skills and coping capacities in school. Moreover, the current study found out that the details of new laws in foreign countries and polices of juvenile cyber-bullying in U.S and Canada including the whole school approach of Australia could be applied to South Korea. Further policy issues will be discussed.

본 연구는 청소년 사이버불링 문제를 다루는 외국의 입법례 및 개입 프로그램을살펴보는데 연구 목적이 있다. 최근 전통적인 학교폭력 발생 비율은 감소하나, 이메일 혹은 스마트폰, SNS를 이용한 전자기기(electronic device)를 활용한 사이버불링(Cyberbullying) 비중은 계속 증가하는 것으로 나타나 이에 대한 선진 외국의 사례 연구 및 관련 대응방안 고찰이 시급하다고 하겠다. 가해자가 일대 일로 대면 접촉(face to face contact)을 하는 신체적 폭력이나 금품갈취 형태의 학교폭력과 달리, 사이버불링은 가해자가 익명성을 갖기도 하고 피해자 신체에 명확한 공격 흔적을 남기지 않아 은밀하게 장기간 지속될 가능성이 많다. 무엇보다도 온라인에 누출된 소문이나 사진합성, 욕설만으로도 피해자에게 평생 되돌릴 수 없는 고통과 정신적 충격을 피해자에게 줄 수 있어 사이버불링 피해를 입은학생과 주변 목격자에 대한 신속한 사전-사후 지원 체계 수립이 무엇보다도 중요하다고 하겠다. 본 연구는 이런 맥락에서 최근 사이버불링을 다루는 외국의 입법 사례와 개입 프로그램 등을 소개하는데 의의가 있다. 실증적인 사이버불링 설문조사나 통계분석 연구는 아니지만, 2012년 이후 최근에 논의되고 있는 외국의 청소년 사이버불링 사례 및 대책방안, 개입 프로그램을 고찰하여 우리나라 사이버불링 예방 정책의밑거름으로 활용한다. 본 연구에서는 사이버불링 입법 동향과 개입 프로그램을 함께 소개하는데 초점을둔다. 특히 미국과 캐나다는 최근의 사이버불링 발생 사례와 입법례 중심으로 고찰하고, 호주, 독일, 타이완은 사이버불링 예방 프로그램 내용 중으로 살펴본다. 외국의사례가 우리나라의 사이버불링 특징이나 발생 추세와는 분명 다르고, 청소년 교육정책 및 비행청소년에 대한 소년사법 역시 상이하다고 하겠지만, 외국의 사이버불링 대응 방향을 검토해 보는 것은 우리나라의 사이버불링 예방 정책을 만드는데 좋은 시금석이 될 것이다. 향후 보다 효과적인 “한국형 사이버불링 예방정책”이 시행되길 기대한다.
