Security system of Intellectual property including paten, trade mark, and copy rights owned by a corporate and a entrepreneur offers the financial institution intellectual property as security and then it makes possible to get the loan within their value. Security system of Intellectual property in China, which were introduced a little earlier than Korea has been utilized actively as a tool of fund-raising. Although a research on security system of China has been conducted in Korea, the study on security system of intellectual property of China has little, if any. In this study, security system of intellectual property of China will be closely reviewing for finding out both characteristics of security system of intellectual property, problems and improvements. Through this, I will be investigating if there are implications for developing security system of intellectual property rights of Korea. Security system of Intellectual property of China were created to promote small businesses and a venture business with nature of a national policy. They are in trouble easily owing to lack of funds despite possessing outstanding intellectual property rights. Therefore, the government has intervened considerably to promote tech-businesses through security system of intellectual property for the financing. Security system of intellectual property of China is stipulated in the Law of Reality and Security Law. A security right of intellectual property in China should be a written contract and it will become effective through the authority from the relevant government ministries. However, some of the issues on security system of China such as the difficulties of security value assessment, the diversification of the mode of transaction, and the government’s excessive intervention is being exposed as demerits. To improve problems on security system of intellectual property rights, I suggest the establishment of assessment institution to simplify and standardize the registration procedure.

지식재산권 담보제도는 일종의 자금 조달 수단으로 기업, 사업자 등이 보유하고 있는 특허, 디자인, 상표, 저작권 등의 지식재산권을 금융기관에 담보로 제공하여 채권은행으로부터 그 가치를 평가받아 자금을 대출받는 제도이다. 중국은 지식재산권을 활용한 자금조달 수단으로 지식재산 담보제도를 우리나라보다 일찍 도입하여 이를 활발히 이용하고 있다. 현재 국내에는 중국의 담보제도에 대한 연구만 진행되어 있을 뿐, 중국의 지식재산권 담보제도에 관한 연구는 미비한편이다. 이에 본 연구는 중국의 지식재산권 담보제도에 구체적으로 살펴보고, 중국 지식재산권 담보제도가 가지는 문제점을 지적하였다. 이를 근거로 중국의 지식재산권 담보제도의 개선방향을 제시하였다. 중국의 지식재산권 담보제도는 ｢담보법｣, ｢물권법｣, 각각의 관련 지식재산권법을 통해 보호되고 있다. 특히 중국의 지식재산권 담보제도는 정부의 정책성 성격이 강한 제도로 발전되는 양상을 보이고 있으며, 중앙정부에 의한 통일된 제도보다는 각각의 성(城), 시(市)정부에 의한 발전이 이루어지고 있다. 그러다 보니 국가 전체에 통일된 지식재산권 담보제도 부재, 통일된 지식재산권 가치평가기관의 부재, 담보대출 범위의 제한이 문제점으로 지적되었다.
