Since 1990s North Korean defectors have been increased rapidly and settled to accomplish with Chinese and give birth the second generation. However, repatriation of North Korean defectors in China has brought the dissolution of family policy, the children of North Korean women was a problem of unprotected or defense in the process. The methodology of this research was in-depth interview of children of defectors in China and investigated the actual situation of their legal, social and emotional problems. The finding of this research are North Korean defectors are experiencing considerable difficulties in obtaining Chinese nationality due to the illegal status of children’s mother in China, and thereby were being excluded from social security such as education and health. In addition, Mothers were suffering from emotional turmoil by the impact of deprived children who have experienced forced repatriation and runaway of mothers. But it could not be conducted the survey on the actual situation of the problem of North Korean defectors in China due to the specificity. The support will have to be more prepared and protective measures with various aspects of systematic research to human rights protection and emotional stability for the future children’s of North Korean defectors.

1990년대 중반이후 급증한 북한이탈주민은 점차 중국인과 가정을 이루고 정착함에 따라 그들의 2세를 출산하게 되었다. 하지만 중국의 북한이탈주민 강제송환 정책은 가족의 해체를 가져왔으며, 이러한 과정에서 북한이탈 여성의 자녀는 방위되거나 보호받지 못하는 문제가 발생되었다. 이 연구는 중국 동북3성에 거주하는 북한이탈주민 자녀의 심층인터뷰를 통해 법적, 사회적, 정서적 문제에 대한 실태를 조사하였다. 조사 결과 중국내 북한이탈주민 자녀는 어머니의 불법적 신분으로 인해 중국국적 취득에 상당한 어려움을 겪고 있으며, 그로 인해 교육과 보건 등 사회보장에서 배제되고 있었다. 또한 어머니의 강제북송과 가출 등을 경험한 아동들은 어머니를 빼앗겼다는 충격으로 인한 정서적 혼란을 겪고 있었다. 하지만 중국 내 북한이탈주민 문제가 갖는 특수성으로 인해 이에 대한 실태조사 조차 진행되지 못하고 있다. 향후 북한이탈주민 자녀에 대한 인권적 보호와 정서적 안정을 위해 보다 체계적인 조사 연구와 함께 이들에 대한 다각도의 지원과 보호 방안이 마련되어야 할 것이다.
