Globalization has become rapidly developing since the 1990s, resulting in tremendous changes in the field of criminal justice. It opens a new era of International Criminal Justice at the international level and increases the awareness of international and transnational crime in criminology. Along with such changes, an international criminal justice system has been established based on the Rome Statute of the International Criminal Court and the creation of international criminal court, in order to build the rule of law for the international community by prosecuting international criminals at the international criminal court. The International Criminal Court comes to establish jurisdiction over four types of international crimes. Thus, this article examines the evolution of international crimes in oder to understand international criminal justice and to define them. It also introduces the legal definition and typology of international crimes. Further, transnational crime, which has emerged as a new threat to the international community under the influence of globalization, has been defined conceptually and this article discusses distinctions between international and transnational crime.

1990년대 이후 가속화된 세계화 현상은 경찰행정 분야에도 많은 변화를 초래하여, 거시적으로는 국제형사사법(International Criminal Justice)의 시대를 열었고, 범죄학적 측면에서는 국제범죄(International crime)와 다국적 범죄(Transnational crime)에 대한 인식을 증가시켰다. 국제형사사법제도는 국제형사법과 국제형사재판소 를 근간으로 국제사회의 법치 질서의 초석을 이루는 제도로 새롭게 출범하였으며, 국제형사재판소는 네 가지 유형의 국제범죄에 관한 사법권을 확립하기에 이르렀다. 따라서 본 논문에서는 국제형사사법제도의 기원과 국제형사사법에 관한 개념을 제시 하고, 국제형사사법제도를 이해하기 위해서는 국제범죄의 개념 정의가 선행되어야 하는 바, 국제범죄의 역사적 진화과정을 바탕으로 그 개념을 논의하였다. 또한, 현행 국제형사법 상의 국제범죄의 유형과 법적 정의를 소개하였다. 나아가서, 세계화와 더 불어 국제사회의 심각한 위협으로 대두되고 있는 다국적 범죄를 개념적으로 정의하 였으며, 국제범죄와 다국적 범죄의 개념 구별의 필요성을 논하였다.
