In September 2009, the Constitutional Court ruled Article 10 of the Assembly and Demonstration Act (hereafter, ADA), banning nighttime outdoor assemblies and demonstrations, unconstitutional. The ruling gave the National Assembly a nine-month grace period to amend the law. However, it failed to do so, with the result that the article lost its force. Even six years after the ruling, no amendment has been made to the ADA, resulting in significant confusion and difficulties on the part of the law enforcement agencies and, more important, creating much inconvenience to ordinary citizens. What led to this legislative failure? What made this legislative void last so long? The present study attempts to answer these questions from a managerial perspective. The literature on strategic management in the public sector implies that the relevant authorities including the National Police Agency may have not been successful in what M. Moore (1995) calls ‘political management,’ the purpose of which is to build support and legitimacy among the actors in the political environment for a policy initiative that a public manager believes creates public value. According to Moore, in order to acquire authorization for a policy move from that environment, one has to be seriously engaged in a series of political management activities, including entrepreneurial advocacy, managing policy development, negotiation, leading public deliberation and facilitating social learning, and public-sector marketing and strategic communication. This study examined whether the relevant authorities, particularly the National Police Agency, properly performed these political management activities. Little evidence was found that they conducted these activities in a strategic manner, indicating that the legislative void over the last six years has to do with the failure at political management.

2009년 9월 헌법재판소는 야간옥외집회·시위를 규제하는 집회및시위에관한법률(이하 ‘집시법’) 10조에 대해 헌법불합치 판결을 내리고 2010년 6월 30일까지 대체입법 마련을 위한 유예기간을부여하였다. 그러나 18대 국회를 지나 19대 국회 후반기에 진입한 현 시점에서도 대체입법은 이루어지지 않고 있는 형국이다. 입법공백이 장기화됨에 따라 야간옥외집회 및 시위에 대응하는 과정에서 일선경찰이 겪는 혼란이 가중되고, 일반 시민들이 겪는 불편함도 점차 커지고 있다. 그렇다면 정부는 왜 주어진 유예기간동안 집시법 10조의 대체입법을 성공적으로 추진하지 못하고, 현재까지 입법공백이 지속되는 상황을 초래하게 되었는가? 본 연구는 이러한 현상을 일종의 ‘정책변동 실패’로 파악하고, 그 원인을 ‘전략적 관리’의 관점에서 분석하였다. M. Moore(1995) 에 의하면 새로운 정책을 도입하거나 기존 정책에 주요한 변화를 가하고자 하는 상황, 즉 정책변동의 상황에서 무엇보다도 강조되는 것은 정치적 환경으로부터 정책변동에 대한 정당성(legitimacy)과 지지(support)를 획득하는 것이며, 이의 실현은 정책변동을 둘러싼 정치적 환경을올바로 이해하고 효과적으로 관리하기 위한 일련의 전략적 활동, 즉 ‘정치적 관리’를 요구한다. 정치적 관리(political management)는 기업가적 옹호, 정책개발관리, 협상, 공적 숙의와 사회학습 및리더십, 공공부문 마케팅과 전략적 커뮤니케이션 등 5가지 실천전략으로 구성된다. 본 연구는 각각의 실천전략을 중심으로 집시법 10조에 대한 대체입법 추진과정의 적절성을 분석하였고, 그 결과를 바탕으로 대체입법 노력이 왜 성공적으로 추진되지 못하였는지 그 원인에 대하여 논의하였다.
