This study analyzed the limitations in the police operation regarding the police response to the crime related to the election for public office and explored a political improvement plan. The reason is that police has not performed an effective response activity due to various legal/systematic factors surrounding the crime related to the election for public office and the factors existent in and out of police organization. According to the result of the study, first, it is believed that police would be allowed of certain extent of discretionary authority as in general criminal case and excessive intervention of a prosecutor would be decreased so that police can overcome the limitations in the investigation. The reason is that, if a prosecutor would actively command and supervise the investigation from the beginning, whole investigation process would be determined by the personal judgment of the prosecutor or by certain political influence. In addition, it is believed that the statute of limitations of the crime for the election for public office and the trust money return system, which are 6 months and 60 days now, would be improved so that police can have more time for thorough investigation. The prosecution would also suggest certain disposition guideline by setting up a clear standard on whether a crime related to the election for public office would be prosecuted or not so that police can set up the investigation scope in the early stage; while the suggesting of an opinion for prosecution and non-prosecution would also keep consistency and objectivity. Second, it is suggested that a permanent organization responding to the crime related to the election for public office would be established in each police station even with small number of staff so that continuous intelligence collection would be done before and after an election and a crackdown and investigation activity on the violations would be reinforced; while the expertise of the staffs in the permanent response organization would be reinforced through the provision of continuous re-education opportunity. Third, the organization of cyber safety bureau would be changed and the number of response staff would be increased for better response to cyber offense related to the election for public office. It has been also found that various supports including budget increase would be required for the improvement of specialized investigation techniques such as digital forensic investigation technique.

이 연구에서는 공직선거 범죄에 대한 경찰의 대응에 있어 경찰활동상의 한계를 분석하고 이를 개선할 수 있는 정책적 방안에 대하여 살펴보았다. 그동안 경찰은 공직선거 범죄를 둘러싼 다양한 법·제도적 요인과 경찰조직 내·외부의 요인으로 인해 효과적인 대응활동을 수행하지 못하고 있기 때문이다. 연구결과, 먼저 경찰의 수사상 한계 극복을 위해서는 일반 형사사건과 같이 경찰에게 일정부분 재량권을 허용하고, 검사의 과도한 개입을 축소해야 할 것으로 판단된다. 검사의 지휘와 감독이 초기 단계에서부터 적극적으로 이루어지면 결국 모든 수사과정은 검사의 개인적 판단이나 정치적 영향력에 의해 결정될 수밖에 없기 때문이다. 또한 각각 6개월과 60일로 규정되어 있는 선거범죄의 공소시효와 기탁금 반환제도를 개선하여 경찰이 보다 철저한 수사를 진행할 수 있는 시간적 여건을 조성해야 할 것으로 보인다. 그리고 검찰은 기소 여부에 대한 명확한 기준을 설정하여 일종의 처분 가이드라인을 제시하고, 이를 통해 경찰이 조기에 수사범위를 설정할 수 있도록 하고, 기소 및 불기소 의견을 제시하는데 있어서도 일관성과 객관성을 유지할 수 있도록 해야 할 것이다. 둘째, 각 경찰관서별로 소규모 인원이라도 상설의 선거범죄 대응조직을 구성하여 선거 전후에 지속적인 첩보를 수집하고, 위반 행위에 대한 단속과 수사 활동을 강화해야 하며, 이들 상설 대응조직의 구성원에 대해서는 지속적인 재교육 기회를 제공해 전문성을 강화해야 할 것이다. 셋째, 사이버 공직선거사범에 대한 대응을 위해 사이버안전국의 조직을 개편하고 대응 인력을 확충하며, 디지털 포렌식과 같은 전문화된 수사기법의 향상을 위해 예산확대 등 다양한 지원을 확대해야 할 것이다.
