We analyze the Korea-China FTA’s non-tariff barriers provisions, focusing on SPS and TBT provisions, with a view to exploring policies for the effective implementation of the FTA. After examining the provisions of Korea-China FTA, we analyze those provisions in comparison with WTO SPS Agreement and TBT Agreement. Also we compare them with the relevant provisions of FTAs of Korea and China, which are already in force. Next we discuss equivalence and the regional sanitary and phytosanitary conditions for the SPS provisions, and international standards and equivalence issues for the TBT provisions. Finally, we address GMO and precautionary principle as the future issues.

본 연구는 한-중 FTA 비관세장벽규정 중에서 위생 및 식품위생 조치 규정과 무역에 대한 기술장벽 규정에 대한 분석으로서 동 FTA의 효과적인 이행을 위한 정책을 논의하였다. 특히, 한-중 FTA 관련 규정들을 WTO SPS협정과 WTO TBT협정과 비교분석하여 동 규정들의 WTO 합치성 등을 분석하였다. 또한 동 규정들을 한국이나 중국이 기체결한 FTA의 관련 규정들과 비교분석하면서 효과적인 이행방안을 제시하였다. 한-중 FTA의 위생 및 식품위생 조치 규정에 명시된 기술협력과 위생과 식품위생 조치 위원회 조항을 살펴본 뒤에 정책과제로서 동등성과 특정지역의 위생 및 식품위생 조건을 분석하였다. 무역에 대한 기술장벽 규정의 경우에 기술규정, 표준 및 적합성평가절차 조항들을 검토한 뒤에 정채과제로서 국제표준과 동등성 이슈들을 분석하였다. 끝으로 향후 이슈로서 GMO와 사전적 예방조치를 제시하였다.
