This specific study addresses a comparative analysis on national and international designated zones of special cases for regulation which are “Free Economic Zones” in Korea and “Special Economic Zones” in China. Especially how to use One Belt One Road(一帶一路), which will lead China for the next 35 years, effectively on the free economic zones of special cases for regulation in Saemangeum is discussed. My research particularly takes an international normative approach about how to settle the disputes that may happen in the future through studying the latest cases of dispute according to Korea-China Free Trade Agreement and WTO Dispute Settlement system in Understanding on Rules and Procedures Governing the Settlement of Disputes.

본 논문은 향후 35년 동안 중국을 이끌 OBOR(一帶一路), 새만금 개발사업, 한중FTA, WTO 그리고 SPS협정 등 최근 한중관계에 있어 매우 중요하게 언급되는 핵심 사업에 대해서 국제 규범적으로 분석하였다. 중국은 AIIB 설립과 함께 일대일로를 통해 중국의 거대한 인프라 투자 및 산업단지 조성으로 아시아를 비롯한 세계경제에 큰 영향을 끼칠 것이며, 이미 이러한 중국과 FTA를 체결한 대한민국은 새만금 지역에 한중경협단지 조성에 박차를 가하고 있다. 이러한 시의적인 필요성과 맞물려 본 연구의 주제는 일대일로의 활용방안 새만금 규제특례지 역에 효과적으로 활용하기 위하여 양국의 규제특례지역-경제자유구역과 경제특구-에 대한 특성을 비교분석과 함께 최근 분쟁사례에 대한 연구를 통해 향후 발생할 수 있는 분쟁을 어떻 게 해결할 수 있는 지에 대한 국제규범적인 접근을 시도해 보았다. 특별히, WTO와 한중FTA 의 규정들을 분석하며 해결책과 향후연구의 방향과 필요성을 제시했다.
