The Korean Criminal Code §10 ① provides that ｢The act of a person who, because of mental disorder, is unable to make discriminations or to control one's will, shall not be punished｣. Therefore, it`ll not be able to be given criminal punishment if a mentally defective person is determined to lack the criminal liability. The problem about judging the criminal liability for the mentally defective person exists in areas where the criminal law intersects with psychiatry. Although the supreme court ultimately judges whether the criminal liability by mental defectiveness exists or not, the judgment of mental defectiveness, which is biological element, needs psychiatric knowledge and it is no wonder to rely on this. In particular, a change is required in the procedure and contents of mental examination for a mentally defective person as implementation of the Civil Participation in Criminal Jury Trial. It is needed the improvement of procedure to submit more accurate mental examination and the result of it in order that jurors are able to understand the result of mental examination and make an decision. This is because jurors consisting of ordinary citizens take part in trial. For guaranteeing the precise result of mental examination in the criminal justice procedure, it is necessary to establish the pool of manpower consisting of psychiatrists or psychologists who have completed the specific educational programs about the criminal justice and legal psychiatry, and it is desired to carry out the psychiatric test with selecting appraisers who belong to a pool of manpower. Furthermore, it is required to draw up and submit the written appraisal of mental examination which is easy to be known because of considering the nonprofessional of jurors consisting of ordinary citizens in the Civil Participation in Criminal Jury Trial. In order to gain a fair verdict of the jury about whether mental defectiveness exists or not, it is recommended the prompt submission of the written appraisal of mental examination, the presentation of the written appraisal of mental examination summarizing the important contents, and making out the written appraisal of mental examination for jurors to understand it easily.

우리나라 형법 제10조 제1항에서는 ｢심신장애로 인하여 사물을 변별할 능력이 없거나의사를 결정할 능력이 없는 자의 행위는 벌하지 아니한다｣라고 규정하고 있다. 따라서 정신장애자가 행위 시에 책임능력이 결여되었다고 판정되면 형사처벌을 할 수 없다. 정신장애자에 대한 책임능력의 판단 문제는 형법학과 정신의학이 교차하는 영역에 존재한다. 정신장애로 인한 책임능력의 존부에 대해서는 최종적으로 법원이 판단하게 되지만 생물학적 요소인정신장애에 대한 판단은 정신의학적 지식이 필요하고 이에 의존하는 것이 당연하다. 특히 국민참여재판의 시행으로 정신장애자의 정신감정 절차와 내용에서 변화가 요구된다. 일반시민들로 구성된 배심원이 재판의 심리에 참가하게 되므로 배심원이 정신감정의결과를 이해하고 판단할 수 있도록 더욱 정확한 정신감정과 결과를 제출하는 절차의 개선이 필요하다. 형사사법절차에서 정확한 정신감정결과를 담보하기 위해서는 형사사법과 사법정신의학에 관한 일정한 교육프로그램을 이수한 정신과 의사 또는 심리학자로 구성되는 인력-풀을구축하고, 인력-풀에 소속된 감정인을 선정하여 정신감정을 실시하는 것이 바람직하다. 나아가 국민참여재판에서 일반시민으로 구성되는 배심원의 비전문성을 고려해야 하므로 알기 쉬운 정신감정서의 작성과 제출이 요구된다. 정신장애 여부에 관한 배심원의 공정한 평결을 위해서는 정신감정서의 신속한 제출과 중요한 내용을 요약한 정신감성서의 제출, 배심원이 쉽게 이해할 수 있는 정신감정서의 작성이 필요하다.
