High expertise is required in special judicial police system as violations of administrative laws and rules become more intelligent and clandestine as social development deepens. Judicial police affairs are divided into general judicial policing responsible for all general criminal investigations and special judicial policing dedicated to investigation of crimes in specific areas. The scope of duty and the content of operation of the latter are limited to specific affairs, which differs from general judicial policing and requires administrative officials equipped with professional knowledge to cover crimes violating such laws and regulations. Diverse social phenomena, expanded economic size and more segmented administrative units are the factors to increase and deepen the duties of special judicial police officers. The recent more ground-breaking national and social development results in more violations of administrative rules and regulations, necessitating more efficient special judicial police investigations. In line with this trend, Seoul set up a special judicial police organization to secure substantial results of the city's policy programs such as safe food and clean air. Seoul Special Judicial Police Organization established in January 2008 is dedicated to specific issues such as food hygiene, environment, medicine, juvenile protection, limited development district and trademark infringement. As of June 2015, Seoul Livelihood Judicial Police Department is staffed by 109 special judicial police officers assigned to six teams, consisting of 43 from the city and 66 from districts. Since the establishment, it has charged 7,343 individual violators of administrative laws, resulting in 979 investigations into violation of livelihood-related laws (18 arrested) that were transferred to the prosecution. Despite the performance, Livelihood Judicial Police Department of Seoul has consistently promoted expansion of their duty to cover illegal loan businesses and other more substantial livelihood violations as their current duty allowed under the laws has its limits to ensure efficient investigation and fulfill the citizens' needs for safety. Based on this understanding, this study explored the matters such as expertise to cover expanded scope of duty, supplementation of the laws to enhance site-based works, and relationships with prosecutors for efficient investigation as these issues will arise with the organization more expanding in the future.

특별사법경찰 제도는 사회발전에 따라 행정법규 위반 범죄도 지능화되고 은밀 화 됨으로써 고도의 전문성이 요구되고 있다. 사법경찰은 일반적으로 모든 범죄의 수사를 담당하는 일반사법경찰과 특정분야 의 범죄 수사를 담당하는 특별사법경찰로 구분한다. 특별사법경찰의 사무는 직무 의 범위와 사무의 내용이 특정 사무로 한정되어 일반사법경찰과 달리 당해 법령위 반 사범 수사에 전문적 지식을 갖춘 행정공무원에게 수사를 하게 하는 것이다. 사 회현상의 다양성과 경제규모의 확대, 행정조직의 세분화에 따라 특별사법경찰의 업무영역과 비중을 확대하게 하는 요인으로 작용하고 있다. 최근 국가와 사회가 비약적으로 발전하고 행정법규 위반사범도 증가하고 있어 특별사법경찰의 수사에도 효율성을 주요시 하고 있다. 이러한 추세에 맞추어 서울시는 시민의 먹거리 안 전과 맑은 공기 확보 등 시책사업의 실효성을 확보하기 위해 특별사법경찰 조직을 운영하고 있다. 2008년 1월 창설된 서울시 특별사법경찰 전담조직은 식품위생, 환경, 의약, 청 소년보호, 개발제한구역 보호와 상표권 침해 등이 직무범위로 지명되어 운영하고 있다. 2015. 6. 현재 서울시 민생사법경찰과는 특별사법경찰 전담부서로 시 소속 43명과 자치구 66명으로 총 109명의 특별사법경찰이 6개의 팀에 소속되어 조직 출범 이후 총 7,343건의 개별 행정법 위반사범을 입건하여 연 평균 979건의 민생 침해 사범을 수사(18명 구속)하여 검찰에 송치하였다. 이와 같은 실적에도 불구하고 서울시 특별사법경찰 전담부서인 민생사법경찰과 에서는 현행 법령이 허용되는 특별사법경찰의 직무범위로는 효율적 수사 및 시민 의 안전수요 충족에 한계가 있다고 판단되어, 불법 대부업 등 민생침해사범 근절 및 수사의 실효성 확보를 위해 직무범위의 확대를 지속적으로 추진하고 있다. 그 러나 직무범위 확대에 따른 전문성 확보문제, 현장성 강화를 위한 법률의 보완이 어느 정도 필요한지, 효율적인 수사를 위해 수사 지휘검사와의 관계 등이 향후 조 직 확대에 따라 수반되는 문제점으로 대두될 수 있어 이를 살펴보고자 하였다.
