Child poverty Countermeasures Law enacted in June 2013, and came into force from January 2014. In August 2014, based on the law “Charter on poverty measures of children” has been approved by the Cabinet. In the future, in consideration of the Charter country-defined, prefectures are expected to determine child’s anti-poverty plan. In this paper, Child poverty Countermeasures Law has been required Japan’s child poverty situation, based on the history of the legislation, and examined the contents of the law, to think about the major challenges of the post-establishment law. History became a law enacted by lawmakers, especially, I also discussed the importance of lobbying by civil society organizations. About Charter based on the enacted laws and legislation, in addition to consider while comparing with the opposition proposal, as the future of the main challenges of the post-establishment law, correction of regional disparities of life protection and school assistance, support for parents, education and welfare I point out the need for cooperation.

子どもの貧困対策法が2013年６月に成立し、2014年１月から施行された。2014年８月に、法律に基づき｢子供の貧困対策に関する大綱｣が閣議決定された。子どもの貧困対策法第９条によれば、今後は、国が定めた大綱を勘案して、都道府県が子どもの貧困対策計画を定めることが期待されている。本稿では、子どもの貧困対策法が必要とされた我が国の子どもの貧困の状況、法律制定の経緯を踏まえ、法律の内容について検討し、法律成立後の主な課題について考える。 議員立法による法律制定となった経緯、特に、市民団体による働きかけの重要性について述べる。成立した法律・法律に基づく大綱について、野党案と比較しつつ検討を加える。法律成立後の今後の主な課題として、就学援助と生活保護の地域格差の是正及び保護者に対する有効な支援のための教育と福祉の連携の必要性を指摘する。
