This study is comprised of two parts. One is on the“actual conditions”of Korea who has difficulty getting consensus toward public conflict management and its resolution. The other is to seek the“solution”of public conflicts-“certified mediator system”- with the study of conflict management system in Germany, who has succeeded in solving post-unification conflicts and becoming an economic model as a influential member in European Union. Germany has a tradition of legalism(Rechtsstaat) and has a basic instinct to avoid public conflicts. Due to this social atmosphere above and mistrust of government, mutual agreements are advised to settle the conflicts in Germany, whereas legal procedures by governmental authority are preferred in Korea. ADR(alternative dispute resolution) as a model of a solution in Germany is recommended in solving conflicts as a creative, wiw-win method of settlement, not a zero sum(win-lose) method. Especially mediation, one of ADR, has been generally utilized as a mutual dispute resolution. To support the mediation system, mediators as real managers in the procedure have been trained and managed systematically in a non-government sector. However, in Korea, practices in public conflict management remain unchanged for a long time. Public conflicts in Korea are also expected to be intensified, diversified and complicated for the next few decades. It is high time we should prepare and maintain a system for conflict resolution considering the integration process after reunification of Korea. To be ready for the circumstances above, a few solutions, such as activation of mediator system and effective education of mediators, can be presented. Above all, the introduction of certified mediator system is urgently needed. Along with not viewing conflicts as problems to be removed right away, mediator system can play a crucial role in development of democracy through civil political participation in our society.

본 연구의 목적은 공공갈등 관리 및 해법에 대한 사회공동체적 합의점을 찾지 못하고 있는 한국사회의 공공 갈등 관리 해법을 동·서독 통일 후 갈등을 성공적 으로 관리하며 모범적인 경제 성장을 이룩하고 있는 독일의 갈등관리 시스템, 그 중에서도 인증 조정관 제도 에서 찾아보고자 했다. 독일의 경우 오랜 법치주의의 전통을 갖고 있으며 기본적으로 공공갈등에 대한 거부 본능을 갖고 있다. 하지만 공공갈등을 용납하지 않는 사회분위기에도 불구하고 정부 정책에 대한 불신 등의 이유로 갈등이 발생하곤 하는데 법과 제도 마련에 주력하는 한국과 달리 자율적 합의도출에 더 큰 정책적 의미를 두고 있다. ADR이 활성화 된 독일에서는 공공갈 등 발생 시 어느 한쪽이 아닌 양자의 승리(win-win), 즉 창의적이고 상생적인 갈 등해결을 뒷받침하는 조정(mediation)제도가 활성화되어 있고 이 조정제도 를 실질적으로 움직이는 갈등 조정관(Mediator)이 민간부분에서 꾸준히 양성, 관리되어 오고 있다. 이와는 달리 산업화, 민주화의 과정을 성공적으 로 거치면서 유래 없는 경제성장을 이룩한 한국사회는 공공 갈등 관리 영 역에서는 여전히 구태를 반복하고 있으며 향후 이와 같은 공공갈등은 한 층 더 심화·다양화 되고 복합화 될 것으로 예상된다. 특히, 남북통일 후의 사회통합과정까지를 고려해 볼 때 지금이 한국사회에 맞는 갈등관리시스템 의 정비가 필요한 시점이다. 이에 대비하여 첫째, 독일 조정관 제도의 한국 적 착근, 둘째, 조정의 본래 목적에 충실한 조정제도의 활성화, 셋째, 효과 적인 조정관 교육 및 인증과정의 제도화 등의 필요성이 제기된다.
