Recently, a number of researches have been carried out in order to understand the research trends in academic disciplines by analyzing the structure of knowledge production and its characteristics. This study analyzes a research trend in the field of legal research using descriptive statistics data analysis as well as network analysis based on bibliometric data from Korea Citation Index during the past 10 years. As a result, we have put forward several remarkable findings as follows. First, according to descriptive statistics, both the research papers in the field of legal research and the legal journals show a steady increasing trend from 2004 to 2009. Possibly, most of this is attributable to the establishment of Korean law schools in 2009 and the 2012-2013 law school accreditation, and it might be worth performing the further research topics; the effect of law school on legal profession, analysis of activities for judicial officers from law school, and the evaluation and prospect of law school system for the successful settlement of law Second, as a result of analyzing the keywords extracted from bibliographic information of the articles in law, “copyright” has emerged most frequently, followed by “damages”, “freedom of expression”, and “illegal activities” among a total of 81,892 words. This seems to happen because the research on copyright act has been actively conducted with increase of copyright dispute since the revision of the Korean Copyright Act in 2006. Third, by the keyword network analysis, “freedom of expression” and “personal information” are found to be high in degree centrality between keywords over time. This explains new legal issues encountered by means of internet accessing with word, mind, personality and so on. Researches on the scope of freedom of expression is expected to be progressed actively in the future through the conflict between law and mental freedom of people based on personal information and freedom of expression. To sum up, this paper shows that the focus of legal research has been shifted from the issues on the concrete and the visible (e.g. consumer protection) to those on the abstract and the invisible (e.g. freedom of expression). Regarding these trends, we expect that investigations on personality and mental freedom based on the rights of the people will be increased in the field of legal studies.

최근 타 학문분야에서는 논문 연구의 지식생산구조와 그 특징을 분석하여 동향을 파악하는 다양한 시도가 이루어지고 있다. 계량서지학적 분석방법은 시간의 흐름에 따른문헌연구의 동향을 예측할 수 있게 하고, 네트워크 분석은 문헌 등에서 추출한 서지정보들 간의 관계를 분석하여 연구동향 분석을 가능하게 한다. 본 연구에서는 최근 10년법학분야 논문 데이터를 기반으로 기술통계 분석, 키워드 분석 및 네트워크 분석 기법을활용하여 법학분야 연구동향을 분석하였다. 위의 세 가지 방법에 따라 최근 10년 법학분야 논문을 분석해본 결과, 특징적인 이슈를 도출해 낼 수 있었다. 첫 번째, 기술통계 분석 결과에 의하면 법학분야 논문은 2004년부터 2009년까지 지속적으로 증가추세이며, 법학 관련 학술지 또한 이와 같은 추세를 보였다. 이는 2009년법학전문대학원(로스쿨)의 출범과 2012~2013년 로스쿨 인증평가가 주 원인으로, 전국각 대학은 로스쿨 인가를 받기위해 인가기준인 전임교원 연구성과와 연구지 발간 실적을 증대시켰을 것으로 분석된다. 성공적인 로스쿨 제도의 국내 정착을 위하여, 향후 로스쿨이 법조계에 미치는 영향, 출신 법조인들의 활동 현황 분석, 로스쿨 제도의 평가 및향후 전망 등의 연구가 지속적으로 필요할 것으로 예측된다. 두 번째, 최근 10년간 법학 논문의 서지사항에서 키워드를 추출하여 분석해 본 결과,총 81,892개의 단어 중 ‘저작권’ 단어가 가장 많이 사용되었고, 다음으로 ‘손해배상’, ‘표현의 자유’, ‘불법행위’ 등의 순으로 분석되었다. 이는 2006년 저작권법의 전부개정 이후로 저작권 분쟁이 증가함에 따라 법 관련 연구가 활발히 이루어진 것으로 보인다. 세 번째, 키워드를 기초로 한 네트워크 분석의 결과, 최근 들어서 ‘표현의 자유’ 및 ‘개인정보’가 키워드들 사이의 연결중심성이 높은 것으로 나타났다. 이는 말, 정신, 인격 등이 인터넷이라는 기술을 만나면서 새로운 법적 이슈가 되었음을 알 수 있었고, 향후 개인정보와 표현의 자유에 기초한 국민의 정신적 자유와 법의 충돌을 통해 정신적 자유의범위에 관한 연구가 활발하게 진행될 것으로 예상된다. 위 분석들을 통해 최근 10년의 법학연구 트렌드를 전반적으로 정리해 보면, ‘소비자 보호’, ‘채무불이행’ 단어 같은 실체가 있고(concrete) 가시적인(visible) 이슈에서, ‘표현의자유’, ‘인권’ 키워드와 같은 관념적(abstract)이면서 무형의(invisible) 것으로 변화하고있음을 알 수 있었다. 이러한 추세에 따라 향후 법학연구는 국민의 권리, 특히 정신적 자유에 관한 새로운 판례와 그에 따른 연구가 증가할 것으로 예측해 본다.
