This study aims at investigating crucial factors that are associated with probation failure of sex offenders in South Korea. It further compares the characteristics of three different groups of probationers assigned to Seoul Probation Offices. The three groups include total probationers who were sentenced to probation and parole, sex offenders who were assigned to probation, and non-sex offenders who had finished probation order in 2013. In addition, the current study examines demographic, informal social control, formal social control, and the characteristics of criminal behavior which might be related with the number of warning tickets among those probationers. Data was obtained from the court documents and official probation card by the support of the Korean Ministry of Justice from Jan, 2014. The total number of sample was 1,624 and the number of sex offenders for the analysis was 144. Multivariate regression analysis was utilized to identify the significant factors that are associated with the number warning tickets. The result demonstrated that the percentage of variance explained by the sex offender model was relatively high, 18% among sex offenders, compared to other two models, 8% for total offenders, and 8% for non-sex offenders. Furthermore, the three models for warning tickets were statistically significant. For sex offender model, education level, probation order period, and community service order were statistically significant factors in explaining the number of warning tickets, when other variables were controlled. Further policy implication will be discussed.

본 연구는 우리나라 성범죄자의 특징 및 보호관찰 준수사항 위반요인을 분석하는데 목적이 있다. 최근 위치추적 전자감시, 성충동 약물치료, 신상정보공개 등과 같은 강화된 형태의 지역사회 교정 제재 수단이 성범죄자에게 부과되고 있는데, 성범죄자들에 대한 인구사회학적 특징과 준수사항 위반 행동에 대한 고찰은 충분히 이루어지지 않고 있는 상황이다. 이에 본 연구에서는 2013년에 서울보호관찰소에서 보호관찰이 종료된 성범죄자 144명을 대상으로 연령, 학력, 전과와 같은 기본 특징을 살펴보고, 보호관찰 준수사항 위반에 영향을 미치는 요인이 무엇인지 실증적으로 살펴보고자 한다. 본 연구의 자료는 2014년 1월 29일부터 약 한 달 동안 보호관찰기관의 도움으로 서울보호관찰소 기록물보관실에서 판결문 및 보호관찰카드 기록 코딩 작업을 거쳐 이루어졌고, 전체 범죄자 1,624명의 자료를 성범죄자와 비성범죄자로 구분하였다. 분석 결과, 전반적으로 보호관찰관의 지도·감독이라는 (1)공식적 통제와 결혼상태 및 직장유무라는 (2)비공식적 통제, 그리고 (3)범죄행동 특징이 전체 범죄자의 경고장 횟수에 유의미한 영향을 미치는 것으로 나타났다. 특히, 성범죄자에게 있어 공식적 통제에 해당하는 보호관찰 기간과 사회봉사명령 시간이 경고장 횟수 증가에 유의미한 양적(+) 영향을 미치는 것으로 나타났다. 이에 성범죄자는 일반 범죄자와 달리, 범행 당시의 특성이나 인구사회학적 특징보다는 공식적 기제 즉, 보호관찰 기간(또는 사회봉사명령 시간)에 따른 개별화된 처우가 필요함을 확인했다고 하겠다.
