Exact figure of the korean child abuse vary from city to city. But in many cases, child abuse crime by parents, real father or real mother contributory factor in at least to 70 percent of child abuse crime, which includes emotional, physical, sexual abuse crime and nonintervention. But many existing studies have drew near in the point of the legal and administrative policy of the korean increasing child abuse crime by parents. But the existing studies of it have the fundamental limit from the point of the 'HYO' concept which contains parents love about many child. Little attention has given to the 'HYO' friendly aspects about the plan of the korean child abuse crime and very few attempts have been made at such 'HYO' friendly aspects Thus in this paper is intended on the 'HYO' friendly standpoint of the korean child abuse. In this connection, from what has been discussed above, it seem reasonable to conclude that the desirable method of the korean child abuse crime should be 'HYO' friendly correction welfare policy and protection welfare policy which contains 'HYO' community and 'HYO' attendance order and 'HYO' program practice order by a family court and a district judge in place of the existing path-dependancy policy of the korean child abuse crime

우리나라에서 아동학대범죄통계는 시군마다 다르지만 대체로 부모에 의한 아동학대범죄가 70% 이상을 차지하고 있다. 그런데 아동학대범죄의 대응에 대한 기존의 선행연구들은 거의가 법적이거나, 행정적인 관점에서 대책을 논하고 있다. 이러한 접근은 효의 개념을 자식에 대한 부모의 사랑도 포함된다는 관점에서 볼 때, 근본적인 한계를 갖고 있다. 따라서 이 논문은 기존의 논문들과 달리 아동학대범죄에 대한 대응방식으로 기존의 방식 외에 효친화적인 관점에서도 접근하고 있다. 기존의 경로의존적 접근대신 효사회봉사명령, 효수강명령, 효이수명령 등 효친화적인 교정보호정책의 접근이 증가되는 부모에 의한 아동학대범죄에 대한 올바르고 근본적인 방식이라는 입장을 나타내고 있다.
