As the fear of terrorism has been spreading across the world, the need for cooperated response to the problem by the international community has recently become more pressing. Although the international community has shown long-standing interest in finding ways to prevent terrorism, the issue only began to officially appear on the international agenda by the League of Nations. Under the supervision of the United Nations, the international community has adopted a series of sectoral conventions against terrorism and is now in the middle of discussing a comprehensive convention on international terrorism. This research examines the key provisions and special features of these international treaties. In addition, it identifies the following problems faced by international conventions on terrorism: First, there is no international consensus on the definition of terrorism. The term terrorism is subjective and can be interpreted differently depending on the subject's political aims and motives. Second, the effectiveness of existing attempts at preventing terrorism is debatable. Despite the various measures adopted to prevent terrorism, terrorist acts have been constantly occurring on the global stage. Third, a question arises as to whether or not the use of armed attacks against terrorism should be categorized as a form of self-defense. Understanding these issues could offer important implications for South Korea’s discussions about ways of preventing terrorism.

테러리즘에 대한 공포가 전 세계적으로 확산되면서 테러리즘에 대응하기 위한 국제사회의 협력 필요성이 강조되고 있다. 국제사회는 오래 전부터 테러리즘 대응방안 마련에 관심을 가져왔다. 그러나 테러리즘이 본격적으로 국제적 의제로 등장하게 된 것은 국제연맹의 연맹협약이다. 이후 국제사회는 유엔의 주도하에 테러리즘 관련 여러 개별 협약을 채택하였으며 현재 포괄테러협약을 논의 중에 있다. 본 연구에서는 이들 국제조약의 주요 내용과 특징을 검토하였다. 그러나 이들 국제조약에 의한 테러리즘 대응에는 다음과 같은 문제가 있다. 첫째, 테러리즘의 정의와 관련한 문제이다. 테러리즘의 정의가 주관적이고 정치적 목적이나 가치에 따라 다르게 해석되고 적용될 수 있다. 즉 테러리즘에 대한 포괄적 정의가 이루어지지 않고 있다. 둘째, 테러리즘 방지의 실효성과 관련된 문제이다. 테러리즘 방지를 위한 각종 조치에도 불구하고 국제 테러리즘이 빈번하게 발생하고 있으며, 또 국내법과 같은 강제성이 없다는 점에서 개별 국제협약에 의한 테러리즘 방지의 문제점이 지적되고 있다. 셋째, 자위권과 관련한 문제이다. 유엔헌장의 자위권과 관련하여, 테러리즘에 대한 대응을 자위권 행사로 볼 것인가 하는 문제이다. 그러나 테러와의 전쟁을 내세운 무력공격을 자위권 행사로 보기는 어렵다. 이러한 문제점은 우리나라의 테러방지입법 논의에 주요한 시사점을 제공한다.
