It is hard to expect for the self-employed to prepare for the risk of old ages guarantee or social risk one by oneself. So, the ways of which the self-employed guaranteed are social problems. There will be some methods. First, regarding all the self-employed as laborers is a one way, and accepting the self-employed who needed to be guaranteed selectively is one of the other ways. If the self-employed be accepted to the social security system, other questions arises. To decide whether a self-employed person will be under statutory subscription or under mandatory one is another problem. And the level of benefit is also need to be decided. It is a delicate issue to strengthen the social safety net for the self-employed. Market entry and terms of business activity of the self-employed are connected to social security scheme. Dichotomous thinking between the laborer and the self-employed is more and more meaningless these days. The time is near for restructuring of the system of social security schemes. While doing this, we must consider the variety spectrum of self-employment. The issue of considering about the qualification of enlisting for the self-employed means the problem that self-employment now has took the social problematic position of equal importance with laborer's unemployment issues. It means the range of employment which social law must care becomes much wider than before.

전체 취업자 대비 자영업자의 비율은 선진국에 비하여 매우 높은 수준이고, 자영업자의 소득수준이 근로자와 같은 종속적 취업자보다 적은 경우도 상당함에도 불구하고, 우리나라에서 자영업자들에 대한 노후대책이나 사회적 위험에 대한 안전망은 거의 제로에 가깝다. 따라서 노동시장의 건전성과 사회적 안정성을 제고하기 위해서는 독일, 일본과 같이 사회보험시스템을 구축하고 있는 우리나라에서는 자영업자를 사회보험제도에 편입시키는 노력이 강화되어야 한다는 지적이 있어 왔다. 자영업자에 대한 사회안전망을 구축하는 데에 있어서 여러 제도적 대안이 검토되겠지만 모든 자영업자들을 사회보장의 영역으로 편입시키는 것이 어렵다면 최소한 보호필요성이 강한 자영업자를 선별적으로 사회보험의 가입대상으로 포섭하는 방안이 강구되어야 한다. 이러한 점을 포함하여 자영업자의 사회보험 적용 확대 방안을 검토한다.
