In Korean society, public consensus still relies heavily on the preconceived ideas that domestic violence should be dealt within its own family while viewing police intervention is an unjust practice by law enforcement. Such public perception results in inadequate responses against domestic violence. As a matter of fact, based on the survey on domestic violence conducted in 2013 by the Ministry of Gender Equality & Family, 98.2% of the respondents said they do not ask for help during or following the domestic violence whereas mere 1.8% sought out for a help. Moreover, since the reasons for not asking law enforcement for help were comprised of 51.8% saying that the severity of violence was insignificant, 24% noting that they were ashamed to reveal their family feud and 10.3% pleading that they simply couldn't file complaint against the assailant, it showed that even the victims of domestic violence considered the violence as a family matter; and such negligence more often than not ended up making it harder to resolve the problems. Consequently, this study aims to examine the cases of domestic violence as well as the role of police force responding to the violence in other nations and to analyze the legal basis of powerful compulsory measures granted to the law enforcement; thus, it is designed to help developing legal basis allowing realistic police intervention and specific enforcement measures rather than merely criticizing the police force for not sufficiently exercising assertive responses in Korea. At the same time, although prompt action against assailants on site is still very important, this study is to focus on the proper role of police force in order to prevent reoccurrences and to protect victims.

우리사회에서는 아직도 가정문제는 가정에서 해결해야 한다는 고정관념을 가지고 경찰권의 행사는 부당한 간섭으로 치부하고 있다. 그러다 보니 가정폭 력에 적극적으로 대응하지 못하고 있는 실정이다. 실제로 여성가족부에서 실시 한 2013년 가정폭력 실태 조사를 보면 폭력발생 당시나 발생 후에 주위에 도 움을 요청하지 않았다는 답변이 98.2%였고, 도움을 요청했다는 응답은 1.8% 에 지나지 않았다. 또한 경찰에 도움을 요청하지 않은 이유도 폭력이 심하지 않아서 51.8%, 집 안 일이 알려지는 것이 창피해서 24.2%, 가해자를 차마 신고할 수 없어서 10.3%순으로 나타난 것을 보면 가정폭력 대상자인 피해자도 가정문제로 여기 고 이를 등한시 하는 인식 자체가 문제해결을 더욱 어렵게 하고 있는 것으로 볼 수 있다. 이에 따라 본 연구에서는 세계 각국의 가정폭력 실태와 이에 대응하는 경찰 의 역할을 살펴보고, 각국에서의 강력한 강제수단의 권한을 경찰에 부여하고 이를 법률적으로 뒷받침 하고 있는 점을 분석하여 우리나라에서도 경찰의 적극 적인 대응이 부족하다는 비판보다는 현실성 있는 경찰권의 개입과 강제수단의 구체적인 조치가 가능하도록 법률적 뒷받침이 되어야 한다. 또한 현장에서 가 해자에 대한 조치도 중요하지만 재발방지와 피해자보호 등 바람직한 경찰활동 은 어떻게 이루어져야 하는지 그 역할을 조명하고자 한다.
