The Manufacturer's Certificate (MC), which is required in Government Foreign Procurement Contracts solicited in the Defense Acquisition Program Administration (DAPA), is a type of joint guarantee from the original manufacturer and the supplier. Unless the manufacturer himself is the DAPA’s contractor, however, it would be very difficult for the supplier to make the original manufacturer guarantee and issue the MC. In addition to such difficulty, the MC would not only cause a cost-push but also restrict competition or the regulation of the bidding. This study focused on case studies in Korea and abroad to find out efficient ways to manage such limitations. The results of this study showed that there was no case wherein such MC was used in the procurement system in any other advanced country. Only cases were found wherein a Certificate of Conformance issued by the manufacturer himself or the Inspection and Acceptance clause of the contractual terms was used in place of the MC. In conclusion, the following were proposed: (i) the moderation of the extent of the quality and defect guarantee used by the Korea Pubic Procurement Service in its MC, (ii) the mitigation of the categories wherein the MC should be submitted or instead of the MC, the contractual terms such as the Inspection or Acceptance clause, and (iii) the exemption from the MC when there is an internationally approved or recognized quality certification. With these measures, the efficient and economical conduct of Government Foreign Procurement is expected to be realized.

방위사업청의 외자조달계약에서 공급자가 계약자인 경우 원제작자가 발급하여 공급 자에게 제공하여야 하는 제작자 증명의 내용은 공동보증의 형태이므로 이에 대한 발 급이 용이치 않다. 이는 경쟁의 제한과 입찰규제의 요소로도 작용하며 원가인상의 요 인도 된다. 이러한 한계와 문제점에 대한 효율적인 방안을 도출하기 위하여 국․내외 사례연구를 통하여 이를 조명하여 보았다. 본고는 이러한 사례연구를 통하여 현행의 제작자 증명의 한계와 문제점에 대처하기 위한 효율적인 방안을 아래와 같이 제안하 고자 한다. 첫째, 제작자 증명의 내용을 공동보증의 형태가 아닌 제작자로서의 품질보 증과 하자보증의 영역에서 이를 담보하는 수준으로 개정하고 둘째, 제작자 증명의 제 출대상을 완화하고 품질보증이나 하자보증의 문제를 계약적으로 해결하거나 셋째, 국 제인증이나 국제규격서이 품질이 보증이 확실시 되는 경우 이를 면제토록 함으로써 결론적으로 방위사업청의 외자조달계약의 효율적인 집행과 국가예산의 절감을 기대할 수 있을 것이다.
