In the progress of economic globalisation, export have great significance in promotion of economic growth for a country in aspects of expansion of employment opportunities and improvement of the international balance of payments position. With accession to the WTO and increasingly deepening integration in international trade, China has experienced great growth in export. However, recently China's export enterprises have been facing much intensified external competition and trade risks. Therefore, Chinese government has been using export credit insurance for support of exports and avoidance of foreign exchange risks. Based on this background, firstly this paper introduced the legal status, main contents and features of the export credit insurance. And then expored the development of status of China’s export credit insurance. Finally, identified legal weakness and its implications of the China’s export credit insurance. In this study, we reached a conclusion that China government should make clear guideline for market entrance of foreign and private capital, financial support from government, and establishment of assotiation and management department in government through the legislation of law of export credit insurance.

세계 경제의 글로벌화에 따라 수출은 일자리 확대, 국제 수지 개선 등 여러 방면에서 일국의 경제 성장에 중요한 역할을 감당하고 있고 이에 각국 정부도 수출 지원 및 수출위험 회피를 위하여 정책적 수단으로 수출신용보험을 활용하고 있다. WTO 가입 이후 중국의 국제 무역 참여가 지속 적으로 증가함에 따라 중국의 수출기업들도 치열한 외부 경쟁과 불확실성에 직면하게 되었다. 이에 따라 중국 정부도 자국 기업의 원활한 수출을 위하여 수출보험제도를 도입하여 운영하고 있다. 따라서 본 연구는 중국의 수출신용보험의 법제도 및 산업 발전 현황을 분석한 후 법제도의 측면에서 현재 중국 수출신용보험의 문제점과 개선 방안을 모색하였다. 연구 결과 중국은 ‘수출신 용보험법’ 제정을 통해 해외⋅민간 자본의 시장 진입, 정부의 재정 지원, 수출보험 산업협회 및 관리부서의 설립 등에 대한 명확한 방향 제시가 필요한 것으로 나타났다.
