This paper considers the problem of special judicial police institutionsin Korea, and propose improvements. In order to attainthe study purpose, this study analyzed the status of the SpecialJudicial Police of the 16 local governments. This study looks atthe installation Atlantic unit, organization structure, personnelmanagement, work allocation of special judicial police. Most of the local governments have installed a special judicialpolice department. But in some cases local governments are notinstalled a special judicial police department. The Work Scope ofthe special judicial police usually conduct business for the 10areas. Special judicial police only perform work for the specifiedfield. Looking at the problem of special judicial police institutions, Thefirst, The organizational unit is too small for the work done that. At least, The work should be carried out with units. Second, adedicated staff must be official with expertise and recruit a dedicatedpublic servant. Third, the scope of work shall be extended. Many law enforcement officers should be granted special privilegesto. New special judicial police office should also be excavated. Forward a new type of special judicial police organization shouldbe established. It is the introduction of autonomous police system.

특별사법경찰제는 행정법규 위반 범죄에 대한 전문성이 요구됨에 따라 산림, 환경,식품, 공중위생 등 특별법규 사범 에 대해서 전문성과 정보력이 높은 일반 행정공무원을 통하여 수사하도록하기 위한 제도이다. 우리나라 16개 특별 시·광역시·도에서는특별사법경찰 사무를 수행하기 위한 전담부서를 설치, 운영하거나, 관리부서 형식으로 운영하 고 있다. 특별사법경찰의 사무범위는 5개 분야에서 10개 분야에 이르기까지 다양하게 수행되고 있다. 본 논문은 특별사법경찰제의 이론적 배경을 살펴보고, 특별시·광역시·도의 실태와 문제점 분석을 통해 개선 방안을 제시한다. 즉, 전국 16개 특별시·광역시·도 특별사법경찰의 조직구조, 인사관리, 사무배분에 대해서 살펴봄과 동시 에 문제점을 분석하고, 개선방안을 제시해 본다. 그 결과, 먼저, 담당, 계, 팀 단위의 조직구성은 특별사법경찰사무의 원활한 수행을 어렵기 때문에 최소 과단위의 전 담부서가 필요하다. 또한 전담인력도 지명분야에대한 전문성을 가진 공무원으로 충원되어야 하고, 특별사법경찰직 렬을 두는 방안도고려되어야 한다. 사무범위에 있어서 특별사법경찰대상 사무가 확대되어야 하고, 사무에 포괄적인 권한이 부여되어야 한다. 그리고 지방자치단체의 특성에 따른 새로운특별사법경찰사무도 발굴되어야 한다.
