Police officers who experience juvenile criminals for the firsttime interact on each other in various ways. Discretion of policeofficer and study on how to execute and use discretion have beenstudied in foreign countries. However, in Korea, study on discretionis not enough and the legal basis under the current lawsystem is hard to be found. The best method to prevent repeatedcrimes in terms of criminology is to reduce the procedure ofcriminal justice system and dismiss the youth through the criminaljustice institutes and police activities. However, Korean police officers do not have authority to dismissthe youth and they have to close the case of criminals who getcharged criminally under the responsibility of police or have tosend a case to the public prosecutor’s office without utilizing diversioneffectively. Due to the effect of that, even after the end of juvenile justiceprocedures, the youth can hardly come back to the normal turflife such as home, school etc. so they are not well re-socialized. Therefore, for the police officers, they are required to have professionals as long as we admit the specialty that some of them arewomen and youth in terms of the improvement of the community-oriented policing to prevent juvenile crimes. So, the systematicselection is necessary. Secondly, through the various activities,Secondly, through various activities, customized actual programshave to be well developed for the teenagers. Lastly, by cooperatingwith the local society institutions such as youth shelter, alternativeschool and Korea Rehabilitation Agency, youth dream center andKorea law education center etc, the youth shall be taught why theteenagers shall not commit juvenile crimes.

2013년 경찰청 자료에 따르면 최근 4년간 검거된 소년범들의 재범률은 2009년32.4%에서 2010년 35.5%, 2011년 36.9%, 2012년 37.3%로 계속 증가하고 있다. 소년 범죄자를 가장 처음 접하는 경찰관은 이들과 함께 다양한 상호작용을 한다. 경찰관의 자유재량과 어떻게 자유재량권을 행사하고 사용하는지는 외국에서도 다양하게 연구되고 있다. 하지만 우 리나라에서는 그러한 연구가 미흡한 실정이고, 현행 형사사법제도상 경찰단계에서 시행할 수 있는 법적 근거가 없 거나 미비한 실정이다. 범죄학상 재범방지를 위한 가장 효과적인 방안은 형사사법기관과 지역사회 경찰활동을통해 형사사법 처리 절차를 줄여 청소년들을 훈방하는 것이다. 하지만 우리 경찰에게는 훈방권에 대한 법적 근거가 없으며, 형사 입건된 소년 범죄자에 대하여 경찰단계에서 소년 사건을 종결하거나 이를 기초로 한 경찰단계에서다이버전을 제대로 활용하지 못하고, 경찰관이 범죄소년을 형사입 건한 경우 무조건검찰에 송치하도록 되어 있다. 그 영향으로 인하여 사법절차가 종료된 후에도 이들이가정이나 학 교 등, 자신들의 생활 영역권으로의 정상적인 회귀가 어려워지게 되면서재사회화가 방해된다. 따라서 사법절차의 초기단계인 경찰단계에서 적극적이고 다양한 다이버전을 실행하기 위한 제도의 마련이 강조되고 있다. 본 연구에서는 소년범죄를 예방하기 위한 다양한 지역사회경찰의 의의를 살펴보고, 외국에서는 어떤 프로그램들이 소년범죄를 예방하고 있는지 살펴보고, 우리나라의 활동의 현황과 문제점을 살펴본 후, 개선방안을 제시하였다.
