The purpose of this paper, it is possible to see the emotions of people participating in civil disobedience, is to try to resolve the chronic evil practices, that is to say ideology debate of korean society. A ideology debate is shown certainly in election campaigns and political discussion each time. No other country is as sensitive about ideology debate as korean society. This is what has been defined because of historical situation and condition of the current divided North-South Korea. In particular, we need a change for our recognition that civil disobedience, a bastion of participatory democracy, is regarded as leftist revolution. The author thinks people give rise to civil disobedience, only if constitution we have codified common sense for the "people's rights and duties" and the "political system" to maintain it, was faced with a situation that has been infringed. At this time, the emotions can be exposed in everyday but it can be seen more intensely in the situation of the tense civil disobedience. What the emotions of people in civil disobedience want to request is common sense and constitutional compliance not an state overthrow and systems change. Therefore we need to continue to resolve the conflict of people through correct recognition for the emotions of people in civil disobedience. Ideology debate prevents the korean society from going to democracy. Now, we must finish ideology debate.

본 논문의 목적은 시민불복종에 참가하는 시민들의 감정을 살펴봄으로써 한국사회의 고질적인 병 폐인 색깔논쟁을 해소하고자 함에 있다. 색깔논쟁은 선거와 정치토론에서 여지없이 등장한다. 한국 사회만큼 색깔논쟁에 민감한 국가도 드물 것이다. 이는 역사적 상황과 현재 주어진 남북한 분단의 조건을 통해 규정된 것이다. 특히 참여민주주의의 보루인 시민불복종을 좌파혁명으로 매도하는 데 익숙한 우리사회의 인식에는 변화가 필요하다. 필자는 ‘국민의 권리와 의무’와 그것을 유지하기 위한 ‘정치제도’에 대한 상식을 성문화(成文化)한 헌법이 침해되는 상황에 직면할 경우, 사회구성원들이 시민불복종에 나서는 것으로 본다. 이때 나 타나는 감정은 일상에서도 표출될 수 있지만, 긴박한 시민불복종의 상황에서는 더욱 강렬하게 드러 남을 알 수 있다. 시민불복종자들의 감정은 국가전복이나 체제변화가 아닌 상식과 헌법준수를 요구 한다. 이에 우리는 시민불복종자들의 감정에 대한 올바른 인식을 통해 사회구성원들의 갈등을 해결 해나갈 필요가 있다. 색깔논쟁은 한국사회의 민주주의 발전을 정체시킬 뿐이다. 이제 색깔논쟁을 끝내야 한다.
