가택구금은 전자감독을 통해 집에서 자유형의 일부 또는 전부를 집행하게 하는 방법으로서 보호관찰과 병행하여 부과되는 것이 일반적이지만 독립처분으로도 선고될 수 있고, 자유형 의 성격을 지닌 변형된 구금형태라고 할 수 있다. 이는 많은 선진국에서 실시하고 있는 제 도로서, 보호관찰 대상자와 교도소 수용자 가운데 비교적 위험성이 낮은 자에게 적용되고 있다. 특히 우리나라는 전자감독제도를 도입한 전 세계 30여개국 가운데, 이러한 가택구금형 전 자감독을 실시하지 않고 바로 GPS체제를 도입한 매우 드문 사례에 속한다. 교정비용 절감과 단기자유형의 폐해 극복, 그리고 가석방제도의 실질화 등을 위하여 가택 구금형 전자감독을 이른바 구금형에 대한 후문형 옵션으로 도입을 검토하는 것이 필요하다 고 본다. 본 연구에서는 이를 위한 방안으로 형사사법단계별로 수사 및 기소단계에서 신병확보 수단 으로서 가택구금, 조건부 기소유예제도의 방편으로서 가택구금, 생계형 절도범에 대한 검 사의 조건부 훈방제도, 공판단계에서 소년(고정주거자)미결구금 회피 대안으로서 가택구 금을, 불구속 또는 단기구금후 석방으로 전환 및 집행유예제도의 개선방안으로서 가택구금 , 효과적 보석제도 활용을 위한 가택구금, 마지막으로 형집행단계에서 일부집행유예제도의 방안으로서 가택구금, 벌금미납자에 대한 가택구금, 단기자유형의 폐해 극복 방안으로 가 택구금, 고위험군 범죄자의 재범방지수단으로서 가택구금 등을 제언하였다.
