The term "telecommunications billing services" means information and communications services to perform the following business activities: (a) Business activities of billing and collecting prices for goods or services sold or rendered by other person (hereinafter referred to as "goods or services") together with charges for the telecommunications services rendered by oneself; (b) Business activities of transmitting and receiving information of transactions electronically so that prices for goods or services sold or rendered by other person can be billed or collected together with charges for the telecommunications services rendered by oneself, or settling, on behalf of another person, or intermediating payments for such prices(Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. §2 (1) 10). The Act is regulating legal relations of telecommunications billing services. Provisions of the Act are not enough to consumer protection using telecommunications billing services. Therefore, to protect consumer effectively, the Act should be amended as following. The first, the telecommunications billing service is one of consumer credits. So, this should be regulated by not the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. but the Electronic Financial Transactions Act. The second, when a consumer contracts to telecommunications billing services contract, a provider of telecommunications billing services provides he/she to informations being related with telecommunications billing services. The third, if a consumer pays with telecommunications billing services, he/she must input a password as previously arranged. The fourth, if a provider of telecommunications billing services is liable for damages to the consumer, a provider should not be exempt from liability. Lastly, the jurisdiction of lawsuit relating to telecommunications billing services should be subject to the consumer's address at the time of filing the lawsuit.

소비자가 재화 등을 거래할 때 이용하는 대금결제수단은 매우 다양하지만, 그 중 하나가 바로 통신과금서비스이다. 이는 소비자가 현금을 지급함에 없이 재화 등을 구입할 수 있으며, 신용카드와 달리 매우 간편한 절차에 의해 대금을 결제할 수 있다는 장점을 가지고 있다. 그러나 이러한 장점은 통신과금서비스 분야에서 소비자피해를 야기하는 주된 원인으로 지적되고 있다. 특히, 신용카드와 동일하게 소비자에게 신용을 제공하면서도 그 이용개시에 있어서 소비자의 의사와 무관하게 통신과금서비스 제공자에 의해 일방적으로 제공된다는 점은 이러한 피해의 근본적인 원인 중 하나이다. 이러한 통신과금서비스로 인하여 발생하는 소비자피해를 예방하고자 2014년 5월 2일에 정보통신망법이 개정되어 소비자의 명시적 동의에 의한 통신과금서비스 제공 및 통신과금서비스 결제시 일정한 정보의 제공 등을 신설하였다. 이러한 개정내용은 이 분야의 소비자피해를 효율적으로 예방하거나 구제할 수 있는 방안이라고 할 수 있다. 그러나 금번 개정법은 통신과금서비스의 근본적인 해결방안이라고 할 수 없다. 따라서 통신과금서비스로 인하여 발생하는 다양한 소비자피해를 효과적으로 예방하고, 구제할 수 있는 입법적 개선이 시급하다.
